Binili ko po rights ng isang beneficiary ng NIA,( nka-title pa po sa NIA un property at dinistribute sa beneficiaries). In-improve ko po ito at ginamit for almost 15 years, kamakailan, may lumitaw na kamag-anak ng beneficiary hawak ang isa ring deed of sale pinirmahan ng daw umano ng dating beneficiary inangkin at binakuran nya ito. Dahil ito ay pag-aari ng NIA, parehas daw kami na walang karapatan sa nasabing lupa, paano na po ung improvements ko?, paano na po ung binayad ko sa dating beneficiary na nang-abandon hndi na ako makapasok sa nasabing lupa, ano po pwede ko gawin?, Sino po sa amin ang mas may karapatan sa nasabing lupa?

Has the other got TITLE?
(The law is some crazy concerning such sometimes, which can make the one, who apply for title FIRST, can get the title !!! Shocked

Has no one, you, the other or both paid property tax for the property at least last 10 years?
Then the title can be APPLIED for for around I believe 2000-3000p. It isn't sure, but good chance to get approval. (If same family has the land and paid taxes since 1947, then it's sure.)

Who has the documents with EARLIEST date?
IF both dates are corect, then the later has probably been scamed by the seller.

What reason does the OTHER say, explaining how it can be his, when you have used it long time?

What does the seller say? (If he is alive and known where he is.)

Just to be sure - is it same property you are talking about, and not just two close to each other? Some documents and maps are not exact...

Title still belongs to Natonal Irrigation Administration they distributed it to farmer beneficiaries. The farmer beneficiary of that particular lot sold his rights to us then he disappeared. Nonetheless, we were in possession for almost 15 years until the other party presented a deed of sale purportedly from the same beneficiary, but the document is dubious. Now, our problem is, they entered the area and dispossessed us. Because title still belongs to NIA, can they disposses us both?, who has the better right between us?

Yes, theirs is dubious. What date has their document? (Before or after yours?)

How if you used it allready? By force?

You didn't answer if you have paid property tax. If you have paid that at least 10 years, then you can "easy" solve it by hurry and apply to get the title.

You using it 15 years is a big plus for you, but can you prove it?

Have you registered yourself as having the NIA right?
If not, do that direct.

Our brgy captain issued us a certification that we have occupied the area for the last 15 years. NIA is already aware of this problem, do you think they will ask both of us to vacate the property?, if so, what happens to my investments?

No, not if they have any sence.

But if so, the others haven't used it in 15 years, so then THEY have LOST their using right... Smile

Ask your Barangay Captain for assistance to force the others away, because the BC can tell the police to do so.

" Yes, we have paid the property tax.."
Then you can apply to get the title, so you can avoid such problems. I have forgot if it's DENR or other, who handle such applications, but they know.
And the value of your land will raise much more than the cost to get it titled.
