Good afternoon!!!! Ongoing na po yung RA 9262 case ko against my husband. Abandonment and insufficient support po yung case. Nung tinuloy ko po yung case against him, he totally withdrew his financial support to us. Pinastop rin po nya sa studies yung anak ko na nasa college level.  As of now po wala kami nrreceive sa knya kahit single cent. Wala na rin po kami communication. Hindi rin po nya dinadalaw ang 2 kids namin. Hindi man lang nya naalala ang mga anak ko nung Christmas at birthday nila.  Masyado na po kasi ako nababaon sa utang dahil kulang nga po ung support na binibigay nya. Ngdemand naman po ako ng increase pero instead na taasan nya ung support eh nireduced pa nya. College at elementary na po mga anak nmin and both studying in private school. Minsan po para na kaming pulubi na namamalimos sa kanya kapag humihingi ako ng tuition fee ng eldest namin at kapag nadedelay ung monthly support. Tinitipid nya po kami pero lagi po sila ngppost sa fb ng mga pictures nila na nasa ibat ibang prominent place. Lagi po sila nagoout of town.  Is it legal po ba na stop nya ung financial support dahil sa dinemanda ko sya?  Nagbabayad daw sya ng lawyer nya kaya wala sya binibigay smin ngayon.  Nung 3rd quarter of 2011 pa po ako ngfile ng case. Lumabas po ang resolution nung June 2012.  Nung September 2012 po naissue ang warrant of arrest nya at don totally stop na ang financial support nya samin.  Bonded po sya kya hindi po sya nakulong. Naissue na rin po ung HDO sa knya. Madalas po kasi sya lumalabas ng bansa to attend convention courtesy of his employer.  Until now po wala pa linaw ang kaso namin. Me chance po ba na maipanalo ko ung case??? Ano po ba ang dapat ko gawin para ituloy pa rin nya ung child support kahit ongoing pa yung case?? He is employed in a multinational company and earning enough to support two families.  He abandoned us nga pala dahil  me bago na syang family. Lahat po nung luxury ay tinatamasa ngyon ng second family nya.  Matagal po ako nanahimik pero ngayon po ang pinaglalaban ko na ay ang karapatan ng mga anak ko.  I want the best and bright future for my kids. Pero nasira po lahat dahil sa ginawa ng asawa ko.
 
Sana po ay matulungan nyo ako na masagot ang mga katanungan ko.

Nagfile ng Support de Pendente Lite yung dating prosecutor ko kasabay ng HDO. Pero yung HDO lang po ang me resolution. Napalitan po kasi ung prosecutor ko, ngfollow up po ako don sa bagong prosecutor ang sabi po nya wala daw po naapprove na support de pendente lite. Hintayin ko na lang daw po ung next hearing. Binigyan ko din po ung prosecutor ng employer name and address ng husband ko para mabigyan sana  ng court ng subpoena ung HR para malaman ko yung total compensation ng husband ko. Ang sabi nya po sakin sa next hearing na lang daw po siya mgrerequest.  Ang ngssuffer po tuloy ay ang mga anak ko. Hindi po nakapagenroll ung anak ko ngayon. Sobrang bagal po ng proseso. Ang last hearing po namin eh nung Feb 2013 pa, marking of exhibits lang po ang ginawa. Try ko po kausapin ung prosecutor ko kung pwede nya ko matulungan sa pgfile ng motion for provisional support. Sir, meron po ba kayo ng draft of the said motion????

naguguluhan po kasi ako, sabi po nung dati kong prosecutor, kapag nanalo daw ako sa case entitled daw po ako sa Support in arrears. Makukuha ko naman daw po yung mga financial support na hindi nya binigay samin.  Sabi naman nung bago kong prosecutor hindi daw nya sure kung makakakuha ako ng support in arrears. Ano po ba talaga ang nakalagay sa batas????

jaemicka, i have no doubt that you are going through a rough time, but it seems to me that prosecutors are doing a good job within the limitations that they face. find another way to ride it out.
