Well currently i badly need legal advice since i don't have proper time to go to PAO yet.

I just want to ask if may ever makukulong ba ang nanay ko kung ang kanyang pirma ay dinaya ng kapatid ko?? confused

Yung house kasi namin ay 3/4 sinangla tira ng kuya ko at siya lamang ang nakinabang sa bawat pera at lahat ng sala tira ay may contract pero hindi namin alam na magkakapatid na kung anu-anug panloloko pala ang ginawa ng aking kapatid at kanyang dinaya ang pirma ng aming nanay. Sa lahat ng kontrata ay hindi pumirma ang kuya ko at ngayon nga ay kami na ang ginugulo nung mga kumuha sa sangla tira at ipakukulong daw nila ang nanay ko kahit alam nila na walang alam ang nanay ko sa utang ng kapatid ko. Sad


Anu kaya ang pwede ikaso sa nanay ko??
Yung bahay pala ay di nakapangalan sa nanay ko kundi ito ay manahin pa.

It is your brother who is in danger of being criminally liable as he was the one who forged your mother's signature! Secondly, the property upon which the sangla was made still belongs to your mother. Sangla or mortgage does not transfer the ownership to the person with whom you mortgage the property.
In fact your mother can sue the debtors to declare the contract(the sangla) null and void as it was forged by your brother.

Hi po,

I have same issue here.

Yung brother ko po ay kumuha ng pera na worth 20,000 sa isa sa mga tenant namin nung naospital po si nanay nung feb.29. Ung tenant po ay napagsabihan na ng maraaming beses na never magbibigay ng pera dahil po sa maraming beses na panloloko na nkuha ung upa sa bahay at ginamit lang nila sa masamang bisyo nila which is illegal drugs nga po. Wala po kaming kaalam-alam sa nangyari at nalaman lang namin nitong paguwi ko sa abroad nung namatay po ang mom ko nung 03/29.

Ngaun po, ang gnawa po ng tenant namin gumawa po ng letter at nakalagay po dun na ndi sila magbabayad ng upa for 3 months if hindi maibbgay yung 20,000 ng 3 months at kapag hindi pa rin nakabayad after 3 months ay di pa rin sila magbabayad ng upa. Ang upa nila ay 7,000/month at nagcmula na silang di magbayad nung feb hanggang april katapusan po.

May laban po ba kami dito kasi ang nakapirma po dun ay hindi ang nanay ko kundi yung brother ko, gnamit nilang reason na wala po sa sariling wisyo ang nanay ko dahil nga po sa sobra na syang mahina at ginawang collateral yung upa sa bahay hanggat di maibibigay yung 20,000.

Patay na po ang mom ko at ang property ay hindi pa nahahati sameng magkakapatid, kaya po gusto ko sanang malamn kung may laban ba kami dito kasi po hindi po nakinabang ang nanay ko dun sa perang yun gang sa namatay sya at ako po ang nagsho-shoulder ng lahat ng bayad sa hospital bill at ginamit ko pong collateral ang lupa namin sa hospital kasi po may utang pa kaming almost 400,000 dun at yung mga upa sa bahay ang inaasahan ko pong makatulong para mabayaran po yung utang namin sa hospital..

Sana po mapayuhan nyo ako ng dapat kong gawin..

what if yung Pirma ng mother ko ay Real pala at nauto lang ng aming kuya yung nanay ko na pumirma? What will be the case?

what if yung kumuha ng sangla tira ay gusto lang talaga mabalik yung pera niya but yung pera niya ay nagastos na ng kuya ko kaya di na mabalik pwede ba yung ikaso as Estafa sa mother ko since baka real kasi yung pirma niya??
