Guys need help
Ang asawa ko kasal sa unang asawa. Nag pa anull .di pa tapos anullment nagpakasal ulit so meaning null and void yung pangalwa. Til lumabas na yung anullment papers at namatay na rin yung unanh asawa eh null and void parin yunh pangalawa unless nagpakasal sila ulit kaso hindi

then pinakasalan nya ako . Sabi ang kasal namin ang tunay kasi considered single ang asawa ko in papers kasi patay na unang asaawa at anulled sila bago mamatay unang asawa. Is that true?

Thanks for the reply. Actually my husband is still a filipino and never sya napetition nung pinakasalan nya na canadian citizen kase while processing the petition, he decided in 2005 to marry me kase kami naman po tlg at may anak na kami that time na isa. Yung naging kasal nila alam ko ceremony lang un ung sinabi nila tpos after our civil wedding in 2005 inayos nung father in law ko ang pagregister s nso then they confirmed to me na im the legal wife. Kaso ngayon n may kinakasama nang iba ung asawa ko. sinasabi nya na di naman legal ung kasal namin kaya wala akong right na maghabol s knya. Kaya
Gusto ko po malaman is kahit ako ung pangalawang pinakasalan. I am using his name and ako ang wife na nakaupdate s lahat ng legal docs nya. Can i file bigamy case against him?

Ito pa po pumasok kasi sa NSO yung pekeng kasal nya sa panagalawang babae ngayon ay nagpapap annull siya or nullity of bigamous marriage. It is crystal clear na peke ang kasal nila kasi nagpakasal sila ng kasal pa ang asawa ko sa unang babae pero ang sinasabi ng attorney nya ay legal daw ang kasal nila . Anung process yung ginagawa nya ? Mag two years na rin yung process. Di namin alam if pineperahan lang sya ng attorney. Salamat . Then would like to have a personal talk with attorney. sobrang kailangan ko lang po talaga ng tamang payo about sa pag na null and void ng marriage contract namin sa NSO.
kami po ay kinasal noong June 2001ang edad po nya ay 16yrs old at ako naman po ay 20yrs old binago po ang birth certificate nya imbis na 1984 ginawang 1982 pati po ang lugar kung saan sya pinanganak.,kaya po kami naikasal sa aglipay. nagsama po kami ng halos 10 taon.,at nagkaron ng 1 anak na lalake. noong 2010 nag abroad po sya me trabaho din po ako noon sa pinas.,hanggang dumating ang 2012 napagdesisyunan namin na sumunod ako at magtrabaho na rin sa abroad.,halos 4 na buwan pa lang kami nagsasama d2 sa abroad ng mabalitaan ko na me relasyon pala sila nung tomboy na kasamahan nya sa work.,nag away po kami hanggang sa nauwi sa pakikipaghiwalay nya sa akin at sumama sya sa tomboy.,ngayon po 2 years ang nakalipas wala man lang pong suporta ang nakukuha ng aming anak galing sa kanya ndi naman po ako naghahabol sa suporta nya ang gusto ko lang po maiayos ko ang aming paghihiwalay sa legal na pamamaraan. sa katunayan nga po lahat po ng dokumento nya, ang ginagamit nya ay ang apelido nya mula pa nung pagkadalaga, hindi nya ginamit ang apelyido ko kahit sa passport nya dahil alam nya nga rin na fake ang kasal namin.Ngyon po may nakausap kaming atty at ang sabi po ay magiging annulment na rin ung civil case ko at aabutin ng malaking halaga

Sobrang naguguluhan lang po talaga ako kaya po nag hahanap ako ng ways para po malaman ang tamang process, kung magkano magagastos at ilang taon tatagal.
Meron po akong hawak na mga documents na magpapatunay na hindi tama ang age ng napangasawa ko sa marriage contract naming, gaya ng salaysay nya, ID, NBI, at birth certificate nya dahil po ni require yun ng atty dati. lubos po akong umaasa na matulungan nyo ako sa tamang proseso at legal na paraan. maraming salamat po!

I need help regarding my friend's previous marriage. Here's the story: Guy marries girl in Catholic Church now after a few months, the girl found out that the guy is still married thru a CENOMAR provided by the previous wife. Guy admits being married before after being shown the CENOMAR. Now the question is: Is the 2nd marriage valid or not? If valid, can the 2nd wife have it nulled?

I am so confused!..
Help!
I am a Filipina married in an abusived alcoholic Man, We have 2 kids and they witness
how cruel his father to me, I work very hard to have some money enough to raise my kids without depending on their father,
My question is Is our marriage is void since our marriage took place first before the issuance of licence,

actual ceremony with witness and contract signing In Mayor's office , then after 6 months we get our licenced at the s
ame time our marriage certificate dated May 2012, The main reason we did this because his Mother is an OFW and she want

Yung kuya ko po kasi may problema.. Nagpakasal po sila nung asawa nya last 2006, hindi po sila nagsama ever since.. Nagkakasama lang po sila kapag umuuwi yung kuya ko dito sa pilipinas pag nagbabakasyon. filipino passport holder pa po sya that time at nakarehistro po sa NSO ung kasal nila. Ngayon po british citizen na po sya.. Ilang taon na din po kasi silang walang contact ng asawa nya, and nakita po namin sa fb na may iba na pong kinakasama yung babae.. Gusto po sana nya maipawalang bisa yung unang kasal nya kasi po balak po niya pakasalan yung bagong gf din po nya ngayon.. Since nung kinasal po yung kuya ko eh filipino passport holder po sya at ngayon po ay british citizen na po sya, ano po ang pwede nyang gawin? Salamat po

Hi, ang pwedeng gawin ng kuya mo ay i-divorce niya ang asawa niya diyan sa U.K. since british citizen na siya. After ma-grant ang divorce diyan sa U.K., kailangan ipa-recognize dito yung divorce decree so that the Civil Registry here can update his records. This is necessary for when he will marry his new gf.

Para sa pagfile niya ng divorce sa U.K., kailangan magconsult ng lawyer sa U.K. yung kuya mo because they have different set of procedures on how to go about the divorce process. A lawyer in the U.K. will be able to assist your brother para ma-process yung divorce niya sa U.K. Smile

Hi, thanks for your reply. Unfortunately, there is no divorce law here in the Phiippines. It would be much easier if i-divorce sa U.K. ng kapatid mo yung wife niya. Pagna-approve na sa U.K. yung divorce, ipaparecognize siya dito sa Philippines through a petition in court. That is the best advice that I can give. Smile

May I say that if her brother did not declared his married to her sister-in-law under UK law, he cannot divorce his wife as he did not declare her as his wife in the first place. So there's no need for your brother to do anything as he is no longer covered under Philippines jurisdiction. The only party has the problem here is her sister-in-law, so she has to file the annulment not him! Not unless your brother has dual citizenship then he can face technicality problem because he is married in the Philippines but not under British law. So if he wish to marry another Filipina he will have a problem but if he marry any other citizen under British law, he should be alright.

Yes, a marriage license is different from a marriage contract. A marriage license is obtained before the wedding, the marriage contract is issued after the wedding.

Solicitor in the UK will not advise him to do that as he already obtained British nationality, if he dare to do so the UKBA home office will investigate with his previous records upon obtaining the citizenship and if they found out he did not declare his marriage in the Philippines in the first place, they may revoke his British passport. So if I were your brother I will not try to attract any attention from the UK government. He need to file an annulment in the Philippines using his Philippine documents such as Birth certificate and any other identification but do not involve his British passport.

He need to clear his record with NSO without conflicting his British citizenship. so it is wise to file for an annulment in the Philippines to be able to marry another Filipina. This is your best shot!
