Hello i need some help,my friend po ako US army and US passport holder na po sya,he's married sa pinas but he filed a divorce sa US and it was already granted,tanong ko lng po ano po dpat gawin pra mavoid ang kasal nya pinas ung mapabilis kc he need to pass sa Army pra mging single na ang status nya...hope my mgreply po sa tanong ko!

since US citizen na siya at nakakuha na siya ng decree of divorce sa US, it is as if he is single already according to US laws so there is no need for further court action. philippine law is not applicable to him anymore.

ang may kinakailangan lang na gawin ay yung babae, she needs to file petition to accept judicial declaration to accept foreign judgment which contains the divorce decree issued by the foreign court at batas na nagsasabi na valid ang divorce decree sa bansang iyon. pag granted ang petition, ang magiging status niya ngayon ay divorced or annulled but not single anymore.

Bkit po cnasabi ng atty nya dpat sa lugar kung saan cla kinasal mgfile,at kung hndi daw pumayag ung girl mgdidecide ung court na mglive-in uli cla w/in 1yr then balik sa court,.ayon po ang sbi ng atty nya,ang kelangan po kc nya ung marriage contract nila na ngsasabing void,pero sbi ng atty nya dpat kunin ung papers sa lugar kung saan cla kinasal!,mejo nguguluhan lng po if tama ba mga pngsasabi ng atty nya

i believe this rule will apply po..

Rules of Court, Rule 4, Sec. 2. Venue of personal actions.

All other actions may be commenced and tried where the plaintiff or any of the principal plaintiffs resides, or where the defendant or any of the principal defendants resides, or in the case of a non-resident defendant where he may be found, at the election of the plaintiff.

kung sa place where the marriage was celebrated, you need to ask your atty kung saang specific na batas or rule po iyon.
