Atty, may kapangyarihan po ba ang Sangguniang Bayan na MAGTANGGAL ng Elected Barangay Official (Kapitan or Kagawad)na nasampahan ng kasong administratibo? Ayon kasi sa Sec.60(h)ng Loc. Gov't. Code: "Such other grounds as may be provided in this Code and other laws. An elective local official may be REMOVED FROM OFFICE on the grounds enumerated above BY ORDER OF THE PROPER COURT."
Samantalang Sec. 61(c) naman sinasabing "A complaint against any elective Barangay official shall be filed before the Sangguniang Panlungsod or SANGGUNIANG BAYAN concerned WHOSE DECISION SHALL BE FINAL AND EXECUTORY." Parang conflicting po yata. Thanks po.
