Is spamming against the law in Philippines?

Arresto Menor

I have a few spam emails in my inbox and I would like to take this to the court. Is there any law that could help me punish the offender? There was a Cybercrime Prevention Act of 2012 however there are no details on whether the section regarding spam went through. It was considered unconstitutional long time ago and there is no info on if the law against spam exists today.

If I am not mistaken, the case of Disini vs. Secretary of Justice elucidates that Spam e-mails are not inherently illegal since such e-mails are in the exercise of a commercial activity, and making it illegal violates the right of the recipient on being informed of such commercial activities.

Hmm.. Thank you. By the way is there any structured reliable source (a website) where I can see the latest law of the Philippines in real time?

Try the usual government websites. I think the PH Congress website may have what you need.

As per Republic Acts, Executive Orders, and the like - www.lawphil.net is a reliable repository of said information. It also has the latest jurisprudence decided by the Supreme Court.

www.chanrobles.com is also a reliable website. Check that out as well.
