Arresto Menor

I have a question po, regarding sa labor code for day 31.
Sa company po kasi namin ay 26 work days means every 31 of month hindi binabayaran ng company. Paano po ba yun? or pag monthly paid po fixed na talaga sya? anong pwede ipakita sa hr namin na dapat po may additional daily wage kami kasi pumasok kami ng 31. Pa help po. Thanks in advance

Yung company handbook po kasi namin is still on process parin po at dipa tapos irevised.

minimun earner, po then 312 days a year po basis sa payroll namin means hindi po namin binabayaran yung working days na natapat ng 31.

hindi pwedeng hindi bayaran.. kasama sa computation yun..

saan galing ang 312 days?? dapat 313 days yan.. kung working kayo nang Monday to Saturday..

299 working days
11 regular holidays
3 special holidays

313 days

Monthly Rate = (Daily Rate x 313 days) / 12 months

if you are a minimum wage earner, arawan an bayad sa iyo, so bawat pasok ninyo ay nababayaran kasi compute ang number of days na pinasok times daily rate. so bilangin mo ang nakuha mong sahod sa isang buwan kung may 31 yan, at may 4 na rest day ka, ang computation mo ay 27 x 512

yung factor ng 313 days ay ginagamit lang para ma compute ang "estimated/equivalent" monthly rate na ginagamit sa pag compute ng benefits na nag de-depende sa monthly rate ninyo tulad ng SSS, Philhealth, etc.

pwede po namin mahabol yung 1day na yun? Kasi iniinsist po saamin na fixed daw po kasi kaya hindi na sya binabayaran pero pag late naman po kami ng 31 may deduction. Same din po ba sa above minimum earner yan?

Hindi po, August 16-30, 2018 po nakalagay at thru computation po di kasama ang 31. Pero po di ko na rin habulin sa company namin.

pag ganun pwede ka pumunta sa DOLE at pakita mo yung payslip mo para ma "inspect" nila ang company mo if they are in compliance with the labor laws.
