Good day po, Itatanong ko lang kung maari ba akong makasuhan ng dating asawa ng kinakasama ko ngayon. Bago pa po kami nagsama ay sira na po yung pagsasama nila at hiwalay na sa isat isa. May napirmahan din po silang kasunduan sa barangay na hindi na sila magsasama at wala na silang pakialam sa isat isa. Ang pumirma po dun sa nasabing napagkasunduan ay silang mag asawa at ang lupon tagapagpamayapa bilang witness. Ngayon po 2taon na pong nakalipas mula ng may napagkasunduan sila ay bigla nalang akong hinaharas ng dating asawa at ipapakulong nya ako dahil kabit daw po ako. Pinagbibintangan nya akong sumira ng pamilya nila gayung bago palang kami magkakilala ng mister nya ay hiwalay at sira na po ang pagsasama nila at yung dating asawa pa mismo ang nag punta sa barangay para magkapirmahan sila na wala na silang pakialaman sa isat isat. Binigyan po ako ng kopya ng lupon ng barangay sa napagkasunduan nilang kasulatan. Salamat po.

The allegations of the wife will be assessed by the courts, if there will be litigation.

Remember, kasal pa rin sila ng kasama mo. By our laws, they are still lawfully wedded and the fact that her husband is cohabitating with you may be construed by the court as concubinage. Pero that depends entirely if there will be litigation, and it also depends as to what case the wife will file against her husband.
