Backpay releasing period

Good day!

My concern is about releasing of my backpay under my previous agency. I resigned as telecollector agent last October 11, 2016. Before I left the company i already file my clearance and ok na po for pick up ng agency ko. My co-worker updated me na nakuha na agency ung clearance. I got the chance para magfollow up about the status kung kelan marerelease ung backpay ko. Nagpunta ako sa agency last January 16, 2017 but they told me na hndi naendorse ng previous coordinator ung papel ko and ung hinahanap na nila nsan ung clearance ko hndi na nila makita. I have no choice but to submit another clearance last February 3. That time nakaleave ung bagong coor and someone assist me that day. February 7, nag follow up ako if naendorse naba ung clearance ko don sa tamang coor ang sagot sakin is nakaleave prin ung tao. Next follow up ko is February 15, hndi sila sumasagot sa mga text messages ko or even my calls. Nakakuha ako ng another contact person don sa agency last March 16. Sinabi ko kung ano nangyari don sa process ng papel ko, sinabi ko rin na resigned ako last October 2016 pa. Sabi nila it takes 60 working days ung process. So nagbilang ako and this coming April 28 ang release ng pera. Nagfollow up ako last April 4, ang sagot sakin ng coor 1st week ako ng June magfollow up. Upon hearing his answer, nagreklamo na ako and sabi ko hndi na tama ung ginagawa nila sakin. Almost 6 months na po ako maghihintay ng backpay.

Kindly please advise po kung anong dapat kong gawin, kailangan po namin ng pera dahil my sakit ang husband ko.

ask k lang po if ilang years of no show of person who resigned or got terminated kung forfeited na po ba ang kanyang backpay? thanks po pa indicate nlng po ng other details regarding this matter.

three years.

Article 291. Money Claims. All money claims arising from employer-employee relations accruing during the effectivity of this Code shall be filed within three (3) years from the time the cause of action accrued; otherwise they shall be barred forever.

so means, it can be forfeited after three years of no show ng tao even if hindi rin xa ng clearance at all?

basta hindi nag claim after 3 years, d na kelangan bayaran
