want ko lang po sana malaman kung meron po b kaming karapatan tumira sa lupa ng napangasawa ng tita ko.. ganito po kasi yun.  yung napangasawa ng tita ko  pinatira kami sa lupa nya ..ngayun po nagpagawa ng bahay yung tatay ko sa lupa ng tito..  then after many years past namatay yung tita ko..ngayun po dahil sa namatay na yung tita ko pinalalayas na kami agad nung tito.. meron po b kaming karapatan na mgstay dun sa lupa.. kc po khit patay na yung tita ko ehh asawa nya pa rin po yun d ba.. kung baga pg mamayarin din nya yun kasi asawa cxa... kasi po kaya kami pinapaalis para yung pinatayong bahay ng tatay ko cla ang gumamit...

Situation and question:

Mr. A availed and granted car loan from Toyota Financial payable in 5 years. After a year, he sold the car to Ms. B (girlfriend of Mr. A) with deed of sale with assumption of mortgage. Ms. B continued to pay the monthly amortization for few months and sold the car to Mr. C, also with deed of sale and to assume balance in the name of Mr. A. In july 2016, Mr. A died. Last November, the people of Toyota Financial found out that Mr A has died, they want to reposses the car to Mr C in their favor since Mr. A died with no co-maker and beneficiary. Does Ms. B have legal responsibility in selling the car? Does Mr. C have the right to demand for a refund to Ms. B?

If Mr. C is paying on time then i don't see any reason why Toyota will reposses the car? All you have you have to do is talk with Toyota together with Mr. C.

Hello po,

You have no legal right to stay on, even if you built a house there, dahil hindi po inyo ang lupa. What you can do is ask for compensation for the house, unless the real owner of the lot asks you to demolish it yourself.

Hi, we need a property attorney na payag sa terms na 60:40 para maayos yung mga lupa ng pamilya ng tatay ko. Since we can't afford an attorney's fees, and other fees. Kasi ang hipag ng tatay ko nasa kanya mother title at sya lng ang nakikinabang sa property ng magkakapatid yet di sya anak. Sya lang ang tumubos ng lupa. ngayon nakasangla ang isa sa mga mga lupa 6,500 sq ft for 65k. Were on the speaking terms dun sa umuupa ng lupa na payag sila na buyer at kailangan lang ng deed of sale at nakapirma 8 magkakapatid. 5 po deceased na. Nagpagawa ng deed of sale un agent namin at kasama yung hipag ng Tatay ko ng hindi namin alam at kumuha pa sila ng 10k sa buyer, pambayad daw don sa deed of sale. Hope you can help us.
