Dear Attys,

Nais ko po sanang humingi ng inyong payo tungkol po sa aking problema sa Birth Certificate.

Ako po ay mahigit sampung taon nang OFW.
Hindi po kasal ang aking mga magulang noong ako po ay ipinanganak sa kadahilanan na ang aking tatay ay namatay ng nasa sinapupunan pa lamang ako.

Ang akin pong pangalan ay naipatala sa aming LCR gamit ang apelyido ng aking tatay. At iyon na rin po ang ginagamit ko mula ng akoy mag-aral maging sa aking pasaporte.

2011 nang kami po ay ikinasal sa aming lugar sa Pilipinas. Sa LCR na rin po kami nagapply ng Marriage License gamit ang BC na galing din sa kanila.

mayroon na po kaming isang anak ngayon na naipanganak po dito sa ibang bansa at naipatala na rin po namin ang kanyang pangalan sa ating Embahada gamit ang aking apelyido.

Kamakailan lamang po ay kumuha ako ng BC sa NSO at aking napag-alaman base sa aking NSO record na ang aking apeyido ay ang sa aking nanay.

Hindi po tugma ang aking apelyodo sa Birth Certificate na galing sa aming Local Civil Registrar at NSO.

Ano po ba ang dapat kong gawing hakbang upang mabigyan ng solusyon ang isyong ito?

pumunta po kayo sa nso at dalhin nyo yung birth certificate nyo galing lcr. sila po ang magpapayo sa inyo tungkol sa process ng correction of entries sa birth certificate nyo. magfifill-up lang po kayo ng form at magbabayad ng required fees. may kamahalan nga lang po ang bayad.

Odd! Papano kayo nakapag abroad ng hindi mo nalalaman ang real surname mo? Dahil ang passport ay based sa birth certificate.

Back in 2000 getting a passport is easy so easy d kagaya ngaun. They dont require NSO copy of BC. BC from LRC ang dala ko sa Regional Foreign Affairs office and within 3 days tapos na ang passport mo.

Strange! I had my passport since 1991. And in that year I was asked to submit an authenticated birth certificate from NSO. And I had it done the next day from DFA special service.

I happen know some people, their passport are produced by traveling agency with similar issues to yours. Now that everything is traceable so those who uses fake documents before are having difficulties to correct their documents that matches their original birth certificates.

Strange maybe. Pero ako mismo ang nagapply ng passport sa DFA regional office gamit lang ung bc from LCR. And yes i remember the same BC from LCR was authenticated by Regional NSO, what they did is was to certify the signatory in my BC was the official signatory by stamping at the back of the paper.
And they only took a copy of it in fact nasakin pa ang original.

Whatever your scenarios is, if that is done since 2000, if there's any falsification involve with your documents, it is beyond the statue of limitation for 10 years. You shouldn't have problem correcting it after 10 years. They will ask you a proof of your old school records or any identification you can prove it's really you and an affidavit explaining what happens.

The famous excuses I know people use was, the travel agent made a changes with the documents and you only had a knowledge of it when you are already at the airport and you realised there's a mistake with your passport but decided to leave although there's a mistake in it because you wouldn't waste the opportunity to go abroad. Kailangan ng Petition sa korte yan hindi pwede na sa LCR lang trabahuin. Anyway ginagamit mo naman apilyido ng tatay mo may mga ID ka naman na kilala ka gamit yun for sure the court will grant it. You look for a lawyer kung san province ka narehistro. This is considered a substantial error and falls under Rule 108, alam na ng lawyer ang gagawin. Basta ipunin mo mga proof na gamit mo apilyido ng tatay mo.

School records, bank accounts, licenses, sss, lahat sila bbearing my father's surname. Recently ko lng nalaman ung nso record ko.

You only need to prove that is the same person. Madali lang ipetisyon yan basta kumpleto ka sa documents. Neutral
