hello,

i need advise coz my younger bro who s 8 years old died in the hospital due to hospital negligence.na ospital cia dahil sa lagnat. after 24 hrs na complaint na ang brother ko na pannakit ong tyan. ang nag assist na doktor sa kanya nag reseta ng gamot para sa skmura kya ra sumakit ang tyan nya dahil 3 araw cia d kumain;after 30 seconds sumakit uli; injection uli ang ginawa ng doktor. after 1 hour d na makahinga kapatid ko.at don cia namatay.and nakalagay sa death certficate dengue hemorhagic fever. d ko maintindhan kng bakit iyon ang nkalagay sa death certifict sa kanya habang 1st day palang namin sa ospital d nla kinuha ang blood test, urine and stool and kapatid ko. and now the hospital r saying dat nagrefuse da ang ma2 ko kunan ng tests ang kapatid ko.pwede ba yon db mandatory na sa hospital na kunan lahat ang suspected cases ng dengue ng laboratory tests. i need your advise. i want justice for my brother

If you are really decided to take legal action, you should hire a lawyer. You have the option to file: (a) a criminal case for reckless imprudence resulting to homicide against the doctors responsible, (b) a civil case for damages against the hospital and the doctors responsible, and/or (c) an administrative case with the PRC for negligence/medical malpractice against the doctors responsible.

You may also seek assistance from the NBI to conduct an autopsy to determine the real cause of death of your brother and to confirm if there really was negligence on the part of the attending physicians. In this type of case, an expert testimony is essential to prove negligence on the part of the attending physicians.
