Hi attyll. Good day! I just want to know more about laws regarding pawnshops in the philippines coz I have a relative who pawned her laptop to a gadget pawnshop recently for 6000.00 Php. They gave her a pawn ticket that states Contract to sell with buy back option. It stipulated there that she has 15 days to redeem the laptop from the pawnshop wherein the interest will be 1070.00 Php. unfortunately, she wasn't able to redeem it or renew it on time due to lack of funds. She checked with the pawnshop who told her they can give her 3 days but she needs to pay an additional 10% penalty fee (600.00). The 3 days passed and she still didn't have to money so she called the shop again to ask for any recourse, she was told they can give her one last extension of 3 days but she needs to pay an additional 10% (600.00). So in total she needs to pay 2200.00 Php interest/penalty fees for the 21days she had the loan. Our question are as follows: 1. Are gadget pawnshops with buyback options governed by the BSP still like any other pawnshop? if not, where should we seek help when it comes to these concerns? 2. The interest is very unconsionable and is there any recourse my relative can do about it? 3. There was nothing written about the said penalty fees on the contract to sell, it was only relayed verbally over the phone, can anything be done about it? Thanks in advance.
