hi!

my mother died 2years ago. my naiwan po siyang lupain na nanakapangalan lang sa kanya,.(patay na po father ko na asawa niya).

7 po kaming magkakapatid, un pong isang kapatid ko ay legally adopted ng tita ko,.

my iniwan pong letter ang mother ko bago siya mamatay,nakasaad sa letter na ang ang kalahati ng lupa niya ay ibibigay nya sakin at ang kalahati ay paghahatian ng aking mga kapatid.

ihohonor po ba ung letter niya kahit hindi napa-notary?

ano po ang kaylangan kong gawin para mahati na ung lupa namin,upang maipangalan ko na ung kalahati sa pangalan ko?

who died first, mom or dad? when was the property acquired, before or after the marriage? how was the property acquired? purchased or donated?

if the letter is fully handwritten, dated and signed by your mom, then it can be considered a will, and the granting of half of her share to you is valid.

dad died first.

binigay po sa kanila ng gobyerno yung lupa.sila po kasi yung mga kauna unahang residente sa lugar na un.. so nung sinabi po ng government na kaylangan ng gawan ng tittle yung lupa, sa mother ko po pinangalan,dahil that time patay na father ko.

ano po ang kaylangan kong i file para mapasakin ung kalahati ng lupa?

you have to file for judicial settlement of estate and have the will probated. you will have to prove that it is in the handwriting of your mother.

80 years old na po kasi yung mother ko nung ginawa niya yung will niya, hindi po masyadong maayos ang pagkakasulat,pero nababasa naman mo.

ano po ang mga kaylangan kong i-present para mapatunayang sulat kamay nga niya yun?

sakin po nakatira ang mother at father(nung nabubuhay pa) mula pa noon,hangang sa magkapamilya ako sa akin tumira ang aking nanay.


inabot po sakin ng mother ko yung letter nung mahina na siya.



pwede po bang magtestify mga neighbors ko,na sakin nga nakatira mother ko?

they can testify that she lives with you, that is fine. but you have to prove that it was your mother who wrote the letter. you will have to produce persons who are familiar with her handwriting. you can also have it examined by the Nbi or pnp lab.

e pano po kung may kasama un mother ko nung ginawa niya yung will?

pwede po bang magwitness yung kasama niya nung time na yun para mapatunayan na mother ko nga ang may handwritting nung will?

yung po bang magrerecognize ng letter e family members
o kahit ibang tao?

anyone who is familiar with her handwriting can testify. if there are witnesses who saw her write it, they can testify also. even better if you are able to provided samples of her handwriting so it can be compared and get a report from the pnp or nbi.

tsaka magkano po kaya ang gagastusin sa pagexamine?
