Gud day po,

Gusto ko lang pong malaman kung meron nakalagay sa labor code kung ilang months dapat para masuspend ka dahil sa tardiness.
Ganito po kasi sa company namin, if you are late ng lampas ng 4hrs in one month magkaka-memo ka for that month pero warning lang po siya ibig sabihin 1st offense palang.
Ang mga naging offense ko po ay:
January 2010 = verbal warning (1st offense)
October 2010 = written warning (2nd offense)
December 2010 = final warning (3rd offense)
February 2011 = 6days suspension (4th offense)

Ang pagkakaalam ko po kasi dapat magkakaron ako ng clean slate this year, which is back to zero na po dapat. Ang sabi po ng HR samin nasa Labor Code daw po yun ginawa sakin na suspension. Ang tanong ko po me nakalagay po ba sa Labor Code kung kelan marerefresh ung mga offense mo sa tardiness. Salamat po in advance.

Refresh ng offense? None in the Labor Code as far as I can remember. Dapat nasa policies ng company yan.

i think what you mean is a rolling period, and indeed, it is not in the labor code, but i find it to be a reasonable innovation by companies.

in your case, accumulated lates of 4 hours is quite lenient, so i cannot agree that a harsher penalty was unwarranted, although 6 days is a bit steep.

Hi Atty,

Good morning po.. May question lang po ako kase our HRD issued memo regarding suspension for lates/tardiness. The memo states "5-10 lates within a month/more than 10 lates a month:
1st occurence - verbal reprimand
2nd occurence - 3 days suspension
3rd occurence - 6 days suspension
4th occurence - 9 days suspension
5th occurence - termination"
and aside from this may deduction sa salary pag late ka kahit 1 minute lang kase wala rin po grace period dahil 9:00am na nga daw ang pasok.
Tanong ko lang po kung makatwiran ba ito?
na masususpend ka na tapos kaltas pa sa sahod mo
nasa labor code po ba natin ito?

yes, i believe it is valid. the deduction in pay is warranted because service was not rendered, but the deduction should equal only the portion that was late.
