Wage Distortion

pag nagkaroon po ba ng salary distortion kasama po ba lahat ng rank and file? I have the IR witm me stating...
SECTION 2. EFFECTS ON WAGE STRUCTURE. where the application of the wage increased prescribed under this Order results in distortion in the wage structure within the establishments, it shall be left to the parties concerned to address the issue in accordance to the procedure under Article 124of the labor code, as amended.

this is from DOLE slide it says:
Article 124 says that the employer ans the union SHALL negotiate to correct the distortions. if there is no union "The employer and the workers SHALL endeavor to correct such distortions" The SHALL in the wording of the law stresses an obligation. The Supreme Court says the term "SHALL" is a word of command that must be given compulsory meaning.
the company is willing to address such distortion but there is a word "DISPARITY" sabi daw yung above minimum wage daw na na may maliit na disparity ang mabibigyan ng distorion.

Which one are you asking kung legal? the shall or the disparity, or all rank and file?

is disparity legal po? then sa pagkakabasa ko po dapat po ay magkaroon ng salary distorion lahat ng rank and file. dahil pag may salary increase ang minimum wage tapos di gumagalaw ang sa regular rank and file employees lumuliit ang gap beetween 5 yrs below at minsan pa mas mataas pa sahod ng minimum wage earner.

kaso ang problema mo is yung word na endeavor. Which means "try or attempt to achieve a goal". So Kelangan mag try.

now po nag try po kami but the thing is lumabas yung word na disparity so now im am contacting atty rio soriano ng wage board para sa paglilinaw but for now since di ko sya makontak nag try ako dito at least idea lang.. on any HR here posible ba na pag nag salary distortion yung malapit lang sa minimum ang na didistorion o lahat ng rank and file? thanks po sa mga sagot..

if wage distortion will be implemented dapat sa lahat.. otherwise, useless yun.. kaya nga may wage distortion para ma align ang wages within the company..
