Hi there, I want to buy a house and lot thru a real estate. I am married for 9years but I am not living together with my husband for 8years because we are not in good terms. My question is, can I buy a house and lot under may maiden name or should I really need to use my married surname?? Actually I want it as my personal property because it's me who's going to pay for it without any help from him. Thanks in advance for answer -Anej Cruz Wink

Hi Anej,

Since you and your husband are still married, the properties you both acquire during the marriage will be considered common properties (shared between the two of you). Even if you use a maiden name or a married name, it will be the same.

If you really want to acquire a property, you may file for a petition for separation of properties with the court. Once granted, the properties you will acquire after that will be your property (and not shared with your husband).
