I have a problem with my previous employer about my separation with them. I've worked in the company ( BPO in Cebu ) for almost four years. Last April 6, I've talked to my manager that I want to resign due to personal reasons and I wanted to render 30 days. However,she wanted to release me immediately on that day. The reason I wanted to render 30 days because I was flat broke and I was planning to go home in Mindanao. And she said, it will not make sense for you to render 30 days since we were over staffing. Which I replied with, I'll think about it first and If I'll get money, then I will resign. Six days later, I submitted my resignation letter and expecting her to release me immediately. However, this time, she demanded for 30 days notice and she reasoned out that the head count is already good. I felt like I was played, like a fool. And I begged for her to accept my immediate resignation ( Cause that time, things had changed, and it was an urgent matter).
But she refused to and even told me if I will not render 30days, I might go as well AWOL. I felt like was bullied when she said that "Are you resigning because you got money? Because it's payday?
If you're not rendering 30 days, I'll tell you, I doubt if there's a company out there who'll accept you." Â In that situation,I broke down in tears and I feel threatened. Since I had no choice, I agreed to render 30 days but I also felt I was coerced. I didn't come back to work the next day and traveled to Mindanao. I called in everyday to let them know that I can't still report back to work.
Two weeks later, I came back to office and I explained my side and gave them a written explanation. Five days later, the 'notice of decision' was termination.
I've been applying for a job for the last two weeks and I kept on failing on background check or during the interview (duh, the word termination, they hate it)
I understand that we need to follow 30 days notice, I've been a really good employee of them. My record with them is excellent. My question is, do I have a case? I just want them to rectify my status since it's hindering me from getting a job.
