Wants file resignation effective immediately.

here is my situation:

1. I have been in the company for 3 months now as their marketing assistant (note: not call center)
2. I want to file my resignation letter effective immediately. reason why i wanna resign is that i don't like the job anymore and i know for myself that i cant give the demands of the position and if i stay longer i wont be able to work efficiently and effectively anymore.
*my IS also once told me that she's losing patience on me already because of my work attitude.

my concerns:

1. i wasn't handed copy of contract upon signing it.
2. i remember the contract that i signed that i have to pay 20k bond if i didnt finish the 2 years contract. (note: they are subtracting a certain amount every cut off for the bond)
3. (note sure if this is in the contract also) --> when filling resignation, effective date would be 40 days upon handing the resignation letter, or time/date approved by company. work must be properly endorse to successful candidate. if we don't comply to this, we are liable to pay the company 25k.

question:

1. if i ask for a copy of my contract, can they tell me that they cant give it right away? do i have the RIGHT to ask for it, if so, MUST they be able to give it to me the day i also asked for it?
2. if i file my resignation effective immediately then the company didn't approve of it, then i didn't go to work anymore, can they file a case on me?
3. is posting a bond or training bond even legal?

1. You have the right to ask for it. They are required to give it to you. But you must give reasonable time for them to produce it - maybe a day or two.

2. Yes. That's job abandonment.

3. Yes, as long as you actually had (or are scheduled to attend) the training. Usually signed a few days before the start of training.

Contract:
They have it in their vault inside the office, its not that hard to get it from the fle cabinet. And its been like 2 and half months since I signed it, so i guess it's just right that they can hand my copy at once right?

Date of resignation:
What if i gave 1 week notice just so that i can endorse it to someone in the office, and they still didnt approve? knowing that i cant work effectively anymore...?!

Can you give me some advise on how to go about this? as i want to resign already, i can't take the demands of the job anymore... my head is not in the game as so to speak...

I suggest you get a copy of your contract so you could have a better picture of what your obligations are and know the possible consequences if you resign effective immediately.

If you fail to get a copy of your contract after a verbal request, put your request in writing and keep the receive copy.

i got the copy of my contract already, and I filed my resignation na.
In my resignation I said that effective of the resignation is after 30 calendar days or earlier approved by the management, but they told me to render 30 working days.

then regarding the 20k bond, I have a balance of 17,150, but I told them that we are financially challenged so they told me to pay 50% of the balance na lang.

we did seek advice from our attorney and told me not to pay for it. but the company is already asking for the payment, due on monday.

i really just don't wanna report to the office anymore...

i was a victim of this..

nagwork ako sa isang known call center.. and contract indicated that we need to stay in the company for at least 1year or else there's a bond of 100k... ok lng nman sa kin.. kaso during my 3rd month, i had no choice but to resign kse umuwi ang yaya ng baby ko who just turned 1year old during that time for her to continue her studies. so no choice ako but to resign (im a single parent).. i filed my resignation and all. everything was legal except i never had exit interview kse when i asked my TL kun anong ggwin next, sbi nya ala na daw and just wait for my clearance; so the day when i was about to follow up on my clearance, i received email coming from the company asking me to pay 96K++. then i started receiving call from the collection dept of the company asking me to pay for the amount otherwise they'll file a case against me and that it will be a hit sa NBI ko.

parang unfair lang kse i had no choice. i was even crying when i was talking to that guy. i even told the guy na sana nde na lang ako nagresign di bale ng alang mag-alaga sa anak ko kung gnito lang mangyayari. and i even told him na anong gusto nyo, magtrabaho ako para ipambayad sa inyo di bale ng alang panggatas anak ko?? unfair...

is it legal ba??? what if nde mo nabayaran yung bond?? can they file any case against the former employee???

moderator

it's a normal collection tactic to threaten you with a criminal case, but none would have prospered. their remedy is to file a civil case for collection.
