Arresto Menor

Hi just want to ask po regarding bathroom break..our manager kc is implementing new rules na ibabawas ung pag bathroom nmen sa break nmen..our sked is 2 pm to 10 pm..we have 3 breaks. 15 mins then 30 mins then 15 mins..is it legal po ba..hope some one could help us..

Do you have a separate lunch break or is it included with the 1 hr?

sa 9 hours, 1 hour dito eh lunch break, then 15/15 umaga at hapon(coffe break),
bathroom break, anytime,,,,
baka naman sensitive ang presence nyo sa work area, like production lines, na di pwedeng maiwan ng walang bantay, kundi ma scrap ang product nyo..
tama c RaheemErick, dapat me supply ng adult diapers,, hehehe

Come to think of it, kung 2-10PM ang shift, then 8 hrs lang yan lahat, so kasama na ang break times dun at binibilang talaga.

malamang nasa production nga work nyan. and i doubt kung bayad yung 15,30,15 minutes break period nya to complete the 8 hours.

kung kasama sa bayad yun? natural lng na mag higpit. but dfntly hindi sa pangungubeta!! :p

kc.. mas tataas yung risk ng sakit sa bato pag nag pigil ng wiwi:)

at sakit naman sa wetpaks pag nag pigil ng pupu:)

pag sa work pa yan inabot? mas perwisyo pa haha!!

i suggest.. with your co-worker. demand and ask meeting for a

"pea's talk"

Kung hindi bayad ang break time, hindi makukumpleto ang 8 hrs, then 7 hrs work lang yan.

regarding sa "no work no pay" basis

1. hourly rate (8-hours minimum)
2. no holidays with pay
3. no leave with pay
4. no lahat!! no work no pay nga eh no? Smile
5. no 13th month
6. no multiplier for overtime (exeed of 8-hours) just overtime straight time. "same rate as regular hour"

yearly contract naman and on time naman ang sahod.

aside sa sahod? may iba pa ba na dpt na meron ang isang sub-con employee under "no work no pay" basis?

Have to read the contract to get better understanding of what's allowed and what's entitled to the 'employee.'

well since nasa contract naman po at malinaw na naka indicate at sinabi don ang terms and policy ng "no work no pay" basis..

eh mukang wla nga yta ako dpt i complain pa.. sa isang banda.. pinirm,ahan ko eh.. haha

bka kako may iregularidad at mali sa gantong basis para nxt month pag renew q sana ng contarct? eh mejo mag dedemand ako ng kung ano ang dapt na meron sa contrata as a sub-con employee kahit sabihing no work no pay terms of employement..

malay ko may yosi alowance man lng dpt diba?

para pag nag renew ako? tatarayan ko ng konte ang hr:)

Hi Good afternoon po. I saw your response on my inquiries po. This is regarding po sa policy na ipinatupad ng pinka Operation Manager po namin. 8hrs po ang duty po nmn ksama na po sa 8hrs yung dalwang 15mins break at isang 30mins for meal.

Ask ko lang po kais ang policy na pinatupad nila is everytime po na mag cr break kami or bathroom break it will be deducted on our 1hour break po. Madami na po ngkaskit sa mga coworkers ko ng UTI po and we are so scared na baka po matulad kami sa kanila. Actually i do reserach regarding sa bathroom breaks and ito lgn po ang nkita ko. Is this applicabl lang for BPO? Kais we are not a BPO po. And I also meron po akong nabasa na sa OCCOPUATIONAL AND HEALTH ACT po yung regarding s bathroom breaks kaso di ko po Makita what article is that. I have spoken already to our OM and she just told me na they need to deduct it kasi nga po bayd naman po yugn 8hrs namn. E lugi nga daw po yugn compny kais nga po ang lumalbas e 7hrs hours lng kmi ngwowork kais nga po yugn 1hr break naming. But ang hirap po kasi na ngammadali kami umihi at minsan ang iba sa amin ay nagpipigil ng ihi pra lang di mabawasan ang meal break naming.. Please help us on this.

SECTION 17. Rest & Meal Periods. – BPO workers shall be entitled to compensable rest
periods and meal periods not less than what is provided for in the Labor Code and other existing laws.
Employees shall have the right to brief restroom breaks, which shall not be shorter than five minutes
each, with intervals of two hours during their working hours. To comply with such, the BPO company
shall devise a mechanism in order to ensure the implementation of regular restroom breaks among its
workers without sacrificing the continuous flow of work among its employees.
