Over break

Good day..hingi lang ako ng legal advice..i was oberbreak ng 5 minutes dun sa allowed na 15 minutes for two consecutive days..binabaan ako ng supervisor ko ng NTE..they charged me with the offense of insubordination and serious misconduct for over breaking and disobeying company rules and regulations..nag explain ako in writting na hindi ko kasi kaya kumain ng 15 minutes..tapos nag baba sila ng decision suspending me for 3 days..tama ba yun sanction na pinataw sakin..thanks in advance sa mga sasagot

medyo harsh ang punishment for 2 5 min infractions but then you shouldn't have answered yung "di mo kayang kuamin ng 15 mins". if really so then don't eat. if you make this a practice they will terminate you

Hindi naman pwede na hindi ako kumain kasi 8 hours ang duty ko as a machine operator nagbubuhat ako ng finish product wieghing 23 kilos.pwede ko bang gawin defense yung omnibus rules implimenting the labor code book 3 rule 1 section 7

section 7 states Meal and Rest Period. Meal period is "Lunch" break in another term. Employee is entitled to it. the twenty minutes that describe in this is the shortest lunch break the employee can have.

for rest period or coffee breaks it states from 5 - 20 minutes. its a range, a guide. Companies set its rest period to 15 minutes. From your explanation, you have violated the rest period or coffee break. if you want to eat during rest period / coffee break, then do it in less than the 15 minutes allowed by the company.

Sir mikos23 yun sinasabi ko na 15 minutes break applies to all break including yun regular meal o yun lunch break yun ang nakalagay sa rules and regulation ng company..pero mas madalas ako sumobra dun sa lunch break kaya nga nag reason out ako na hindi ko kaya kumain ng 15 minutes kahit mas marami na yun lunok kaysa nguya and besides that yun position ko na machine operator engage in physical exertion.although computerize yun machine pero yun finish product weighing 23 kilos ay kelangan buhatin pag napuno na to replace it with another cartons..thanks sa pagsagot sa mga tanong sir..GOD bless

15 minutes break is a coffee break only. usually after the first 2 hours of work or after the first 2 hours after lunch break.

I was in a production company before, and the production staff are carrying sacks of chemical every hour, and that's 55kg. They can still take their 15 minutes break and never go beyond it and same for their 1 hour lunch break. I don't think you can be excused for this.

Unless you are paid for 12 hours, 8 straight hours and 4 hours overtime period, you may invoke the omnibus code that you stated, that meal (lunch) break should not be less than 20 minutes. if less than 20 minutes, you meal (lunch) break should be a paid break also.

masyado namang mahaba yan 12 hours tapos dalawang 15 mins break lang? Ilang hours kayong binabayaran? 4 hours OT ba?

on straight time there should be 10 mins on coffee break and 20 mins as a lunch break.. dun ka kumain sa lunch break para di ka kapusin sa time.. yun lang kung 15 15 ang binigay na break sa inyo.. need mo po mag adjust po..
