MARRIED TO A PERSON WITH DIFFERENT NAME

Good day to all.

I would like to seek for a legal advise regarding my case. I got married year 2000 and for 12 years. Early Last year, my husband went to NSO to secure a copy of his late registerd birth certificate which he is using when he was 6 or 7 years old. He found out when he requested for an authenticated copy of his birth certificate in NSO that his NAME and SURNAME were different from the birth certificate issued to him. NSO mentioned that for those late registered birth certificate with initial birth certificate will be archived.

Now here are my inquiries:

1. What will happen to our marriage as I am using my husband's surname based from his late registered birth certificate? Is it null and void?
2. How about my children, they are also using the surname of their father?

if you want to fix it, it is easier to change the last names of the children and you through a court petition for correction.

the harder route is to file a court petition for change of name by your husband.
