we have a dilemna, a friend has tendered his resignation and is currently serving his 30-days notice, when a notice for termination (just cause) was served. IS there a possibility that he can be terminated before his effective date of resignation? If termed, will he not be eligible to receive his benefits from the company?

if his resignation was accepted then he could no longer be terminated.

what if there is a pending case and you were suspended but the employee decided to resign but the company says even if she will resign she will be terminated because she has a pending case in the company. is the employee can have clearance and avail her backpay and 13th month pay?

then the company shouldn't have accepted the resignation. Resignation or Termination, employee is always entitled for wages earned and pro rated 13th month pay.
