mapanggulo yung ex wife at laging nangtethreaten sa guy at girl. the ex wife and the guy are already in the process of annulment technically registration of decree na lang hinihintay. the ex wife is a teacher and we're wondering how to force her to use her maiden name in all of her papers? including iforce sya na gamitin ang maiden name nya during classes, etc. completely mawipe out ang connection ng surname ng guy sa kanya?

what to do pls?

Try a Motion for Clarificatory Judgment in the court which granted the annulment.

Once a married woman has opted to use the surname of her husband, she shall continue using the same until her marriage with her husband is validly terminated. Hence, a married woman shall only be allowed to revert to her maiden name: annulment, declaration of nullity of marriage, divorce decree obtained by the foreigner spouse, and death of the husband (Section 5(d), RA No. 8239). In case of annulment, it shall be necessary for the applicant to present a certified true copy of her annotated Marriage Contract or Certificate of Registration and the Court Order effecting the annulment.

How can she force the ex wife to revert to the maiden name? I am thinking she can file a motion for clarificatory judgment for the court to include in the order of annulment that the ex shall refrain from using the last name of her former husband.

thank you atty.

we are also wondering if pwede magfile ng restraining order habang naghhintay ng certificate of finality or yung tnatawag na registration of decree against the exwife for using facebook? or kailangan matapos po muna ung process ng annulment? the exwife still continues to fool her friends na magkasama pa rin sila at masaya. shes posting statuses and photos that suggest magkasama pa sila which the guy thinks harm his reputation.

pls help
