Separation from work issues.

Good day!

Meron lang po akong mga katanungan with regards sa previous employer ko.

1. Nagfile po ako ng aking resignation June 26, 2012 at yung effectivity ay 30 days after (or July 26, 2012). June 30 wala na po akong natanggap na sweldo. Tama po ba ito?

2. As per company policy, i turned over all documents and accountabilities na nakaassign sa akin before my last day. yun nga lang, yung clearance period is aabot ng up to 6 months dahil sa pawnshop po yun at yung clearing is after auction period nun last na appraisal na ginawa ko. Yung issue is CASHIER po yung last position held ko, although na there were unavoidable times na ako yung mg-appraise pag wala ang appraiser. Tama lang po ba yon na i-hold nila ng 6 months yung last salary ko?

3. AS of this moment, i know na meron nang ginawang clearance yung auditor with regards sa resignation ko. pero as of now, wala pa rin pong concrete information as to when they are going to release my last salary. Yung excuse nila is on-leave yung HR, pero every week po ay ipina-follow up ko yung status ko sa area manager. Ano po yung pwede kong gawin para mas mapadali ko yung proseso?

4. 7 years po akong ngserve sa kompanya with no badrecords. Although voluntary resignation, mkakaavail po ba aq ng separation pay? Ano-ano po yung mga benefits na pwede ko maavail?

you are not entitled to separation pay.

make your follow ups in writing so you have a paper trail. your option is to file a complaint at nlrc.

i already sent my follow up letter last Jan. 5, 2013 and as of now, i haven't heard from them, nor received any reply. is it ok to send them a demand letter? or should i file a complaint at nlrc na?

make constant follow ups, do it on a weekly basis kung pwede. If there is still no movement, you may file a case with the NLRC thru SENA already.
