i filed a case at the nlrc against my employer for illegal dismissal here in our place outside manila. the respondent filed a motion to change venue to transfer the hearings at manila but was denied for lack of merit. we had two arbitration dates but the respondent failed to attend all of those hearings. but the labor arbiter set another schedules to conduct another set of hearings instead of letting me file my position papers, just to let the respondent attend the hearings. my questions are:
1. is the labor arbiter's decision to set another schedules for hearing fair enough for me who attended all the hearings even if the second and final date of hearing is finished?
2. will that affect the labor arbiter's decision in favor of me after the next set of hearings will be concluded?
3. what will be my advantages over the respondent who failed to show despite due notice to them?
your suggestion is highly appreciated. thanks!
