hi everyone, newbie here at this forum though i provide updates from other site (skyscrapercity). just locate phil, qc, victoria station2. As I mention from that forum, I'm also a unit owner, I bought 2 unit combine last march 2012 and never had regret of getting one or two. anyway, let me update everyone as well here. I heard that developer permit to sell already given to vs2 from HLURB...you can check to confirm. if my agent able to, she will give me a copy of it as well. also heard the construction is being done 24hrs and it already had a big improvement...atleast since last time I post a pic in mentioned link...Smile

For those planning to do full refund, I don't think you have a chance especially if you don't have concrete reason or unless the company is not planning to continue to build the condo anymore...atleast this is what we signed for. I'm also worried as everyone since this is my first investment and I'm working abroad but I do believe in this project...the location is one of the reason I get a unit here which is better than most of the other developer condo's location. the amenities is superb, no other developer able to provide such a thing...unit price is not that bad also...atleast cheaper than others. building full plan is so great which is the other reason why you get a unit here before...same as me.

buying a unit is always have a risk especially if you get it during pre selling whichever what developer it is...though you get the cheapest price you can buy for same unit and you can select the unit location based on your budget...but you will only know this great plan is being followed once the building is completed...which part of the risk we are facing.

Heard last year, unit already increase and will keep on doing that everytime there's a progress in construction...security is already tight in the area, a lot have change since I get pics last time...my agent will try to take a shot and send me a copy...and post it again in the forum.

But think of this, if all the reason why you get a unit here was followed and all the great plan was implemented successfully or better than expected. definitely we'll say, good thing I bought one here especially once you feel the convenient of transportation, infinity pool, spa, gym, sport complex, jogging area, parking, shops...etc

Honestly I don't bother about delayed license to sell, this project is not their first time to build. they already have a lot of condo's and projects completed other than this and not even get problem getting this license. They know what they're doing, just leave it to them...this is there's biggest project so far, if they get some issue from previous project...hope they improve a lot from those mistakes... Very Happy Unless you get other better offer from other developer, this may only reason why you still keep on getting a refund even not yet seen the project completed...lol

Anyway, I want to thanks my agent (Jezeca Asuncion) for updating me always, giving me a lot of information even providing me a copy of SOA and contruction pics, news from time to time....even without me asking her...I know a lot of unit owner is getting problem communicating with their agent especially once the deals finished, that why I'm bless of getting agent like her... Very Happy I know it's very important to us to get updates especially those working abroad or staying far from the area, this will not only makes us excited in the project completion but also feel relieve and satisfaction in the money we invest.

Kaya kung ako sa inyo guys, DMCI na lang kayo or ayala. Marami mura sa ayala under Amaia and Avida. pero syempre mas mahal yan compare Victoria Station, mura nga sakit naman sa ulo dahil sa dami ng prob. Ayala or DMCI, sakit sa bulsa kasi mahal. pero sure ka naman sa units mo at okay ang after sales nila. so mamili kayo, SAKIT sa ULO or SAKIT sa BULSA.

I registered in this forum so I can share our story with you.

My boyfriend-then and I invested in VS2 last November 2010. IT was our first investment as well (we even prioritized this over our wedding).

for the same reason as what most of you shared in this forum, it was September 2012 when I had to dig in for more details as to why the construction site for VS2 is still a HOLE even after 2 years. i was actually bothered because back then, i knew that we'll finish the 20% DP in 1 year time, so what happens next? definitely, banks and even pag-ibig will NOT allow you for loan KUNG WALA NAMAN UNG BUILDING, to start with.

so, i had one-on-one, full detail discussion with my salesman. ang sabi nya sa akin, "yes mam, u cannot apply for loan sa bank and pag-ibig dahil wala pa ung building. kaya kailangan nyong mag-inhouse financing". and there, naramdaman kong umakyat ang dugo ko. i was really really mad. the hell, in house financing is at 16% for 10years versus 8% in pag-ibig for 20years! that's crazy!

i was really stressed that time:
(1) i demanded for reund, but same reason was given to me, the MACEDA LAW which entitles you 50% refund only after you have paid 24 months.
(2) i talked to a lawyer from Vista Land (Villar Property). according to her, this is really the risk in PRE-SELLING, kaya dapat, trusted developer. her advice is for me to weigh my options, demand for refund and accept losses, or continue through inhouse financing and carry the burden of paying high interest

i talked to my salesman again and informed him that all options given to me were inhumane. i told him to think of other possible way. and in all fairness to my salesman, he did. this was the option given to me:

TRANSFER ALL MY PAYMENTS FOR VS2 TO OTHER NSJBI EXISTING PROJECTS Smile

so that time, we have already deposited around 200k for VS2. then we acquired 1 unit in FRANCESCA TOWER (along EDSA, "almost" beside VS2 site).

good thing about it, even though the building is like 5 yrs old already, i think we still got the value for our money.

what we bought in VS2:
21.sqm ==== 1.7M

what we got in Francesca:
43.sqm ==== 2.1M

well, it's not fancy, there's no recreational facilities, but hey, we just had a double the size loft-type unit for adding around just 400k. PLUS! we get to move in right away.

going back, we started with the heated argument in September, and come November, we are already in our loft Smile

So guys, I suggest, try inquiring with your salesman if there are still other units available in Francesca Tower or even in other buildings like Victoria STation in TImog or even VS1 in EDSA as well (the one connected to GMA mrt station).

i understand that it's all just work for you. i know hindi nyo rin gusto ung nangyayari dahil customer facing kayo, and for sure, kayo ang tumatanggap ng lahat ng galit ng customers.

HOWEVER, the least i expected back then from my salesman is TO INFORM ME. paano na lang pala kung hindi ako OC, inintay kong matapos ang 20% DP namin, ano na nangyari? pipilitin nyo akong mag-inhouse financing? hindi naman fair un.

also, please REFRAIN FROM OVERCOMMITING. from 2010, ang sabi sa amin, FULL SWING CONSTRUCTION. i remember you even had catering services sa site, complete with banners and all. pagdating ng 2011, wala pa ring hukay. i asked my salesman, ang sagot sa akin, "MAM< 2013 PA RIN PO, MARAMING PROJECTS, HINDI KAMI PWEDENG MASIRA". pagdating ng 2012, iba na ang tono, "MAM, 2014 NA PO". pagpunta ko sa main office, mas malala. "MAM, 2015 NA PO".

inasmuch as i would want to understand where you are coming from, i hope you also understand where WE, AS CLIENTS PAYING FOR THIS, are coming from as well. i mean, sana maintindihan mo din na sa situation na ito, YOU AND THE REST OF NSJBI GETS PAID, habang kami, PATULOY NA NAGBABAYAD KAHIT UNG CONDO UNIT E HINDI PA NAPAPAKINABANGAN.

kahit masaya na ako sa loft namin, i did a little more research on this issue since nakakabother talagadahil maraming affected.

apparently, may mga sinwerte na nakapag FULL REFUND. i think they filed cases sa HLURB, then hearing (mostly took 4months).

Hi newbie!!! Ako rin bought a tandem dyan sa v2
2 months nalang tapos ko na dp dont know what to do gusto ko irefund nalang sana papayag kaya cla.. grabe sobra naman nila move yung project sabi nila sakin 2013 turnover .. matutuloy pa kaya tong project na to kelan? pano gagawin sa remaining 2 years ko?

Kami kasi last year, ang ginawa namin ay nirequest na itransfer lahat ng payment na nadeposit namin for VS2 to Francesca Tower, around 200k na din un. Ung francesca kasi, existing condo na, so currently, naka-move in na kami agad kasi ung 200k ay pasok na sa requirement na 5% deposit to move in. pwede rin sa victoria station sa timog or sa VS1 sa GMA MRT station ka magpalipat.

although, i read from another forum na nakarefund sila. you need to file a formal complaint sa HLURB. nakapag full refund sila except for the 10k na reservation fee. inabot ng 4-6months ung process bago na refund.

pili ka na lang kung anong option ang pipiliin mo Smile

yup, pero i suggest wag na ung lawyer na may mahal na professional fee. marami na rin ako nabasa na forum about this (kahit dito lang sa thread na ito). mejo may pattern na rin kasi kung paano ihandle ng NSJBI ung case na ito:

1. pag kinausap mo ung salesman mo, sasabihin syo na by Maceda law, 50% lang daw ang makukuha mo tapos kung anu-anong charges ang ibibigay syo. and ending, around 20-30% lang mababawi mo (NEVER EVER TAKE THIS OPTION, pera mo un, wag ka papayag!)
2. transfer your money to an existing project. ito ung napili namin na option. kung patapos ka na sa 20% DP, i assume nasa 200k na rin ang nabayad mo. so pwedeng pwede ka sa option na ito. kami naman, hindi nagsisi. kasi ung unit na kinuha namin sa VS2, 21sq.m. lang tapos 1.7M. ung kinuha namin sa francesca, 43sq.m. (double the size, up and down) tapos 2.1M. so 400k lang nadagdag, double na ung laki. higit sa lahat, nagagamit na namin ngayon.
3. marami na ang nakapag FULL REFUND. ang warning lang dito ay mahaba at matagal na proseso. sa HLURB ka magfile ng case, tapos several times kang babalik para sa hearings. sa mga nabasa ko, may umabot pa ng 8months bago natapos ang hearings, then nagrequest pa si NSJBI na 2 gives ang payments, for 2 months. kung hindi ka naman nagmamadali magkaron ng bahay/condo at may time kang magprocess nito, pwedeng ito ang option na kunin mo.

Sobrang stressful ng pinagdaanan namin kaya i know what you're going through now. atleast ngayon alam mong maraming options. nung kami last year, feeling HOPELESS na talaga, haha.

Salamat akosipipay... Nakaka pang lumo talaga 2 unit kinuha ko tapos plus miscellaneous and goverment fee pa na cnama sa monthly ko so malakilaki talaga hay nako sayang . Actually wala naman magging prob kung matutuloy project atleas tutuloy ko lang yung payment with no interest untill turn over .. Atleas nabawasan na yung balance ko but the thing is kung hindi matuloy doble doble nasayang na pera...

ang huling balita ko, lumabas na ang license to sell, so tuloy ang project. ang tanong dyan, KAILAN MATATAPOS?

ang isa pang kailangan mong iconsider ay: patapos ka na sa downpayment mo na 20%. ibig sabihin, papasok ka na sa 80% financing. dahil wala pa ang building, HINDI KA MAGAGRANT NG LOAN NG PAG-IBIG OR BANK. cyempre lugi sila, walang collateral. therefore, ang choice mo lang ay IN-HOUSE FINANCING. dito ka mag-isip ng mabuti. sa inhouse finaning, 16% per annum ang interest for 10 years. sobrang bigat nyan! versus around 8% lang sa pag-ibig or 10% sa bank for 20YEARS. double check mo ung contract to sell na pinirmahan mo sa NSJBI. magugulat ka sa monthly payment mo for in house financing, sbrang taas nyan for sure. dahil 2 units ka, baka hindi ka bumaba ng 40-50k/month.

pag-aralan mo ng mabuti ngayon kung anong option ka. dahil 2 units ka, i assume around 400k na nadeposit mo. i highly suggest either MAGPALIPAT ka, or, MAG FULL REFUND ka na. be very careful sa pag commit ng in house financing. luging-lugi ka nun. considering, wala pa ung condo unit, hindi mo pa napapakinabangan. baka ma FULL PAYMENT mo na in 10 years, wala pa ang unit

Hi. Now ko lang to nabasa. Akala namin kami lang nagdududa. Almost a year na din kaming nagbabayad, matagal na pa lang madami nagrereklamo, bakit kelangan pa po ng hearings isa isa. Why not order NSJBI to refund all payments by their clients ASAP if wala silang license to sell?

i think may license to sell na sila as of december last year e. as per this thread naman, i think may nag-try ng refund as a group. cguro hindi inorder ng HLURB na ibalik lahat kc technically, nasa process naman sila ng pag request ng license to sell, may nabasa ako na nadelay (for some reason) din sa side ng HLURB. maaga-aga ka pa. mejo pag-isipan mo na rin Smile pero kung sa tingin mo ay aabot naman ang turn over ng building pagtapos ng DP mo (i assume 2 more years), ok lang. pero sa looks ngayon ng site, mukang malabo ang 2 years... nakalipat kmi sa francesca november last year, so every day kong nakikita ung site, almost half year at hindi pa rin sila tapos sa paglatag ng foundation,...

Should we decide na ilipat na lang ung investment namin sa ibang projects? Kasi gusto na din namin lumipat na lang kesa patuloy pa kaming magbabayad ng may mga issues regarding sa year of completion. Nakikita rin kasi namin na mukhang malabo ang 2 years. Makakalipat pa po kaya kami and refund our payments kahit merun na silang license to sell?

i think YES, kasi dalawa naman ang na-raise na concern sa kanila:
1. no license to sell (pero meron na ata)
2. turnover date (na patuloy nadedelay)

just to warn you though if you want to transfer your payment sa ibang existing project, kailangan ng 5% outright downpayment para makamove-in ka na rin. since wala ka pang 1 year nagbabayad, i assume wala pang 100K ang nadeposit mo? so you need to make up sa kulang. kasi like sa amin, 2.1M ung nilipatan namin, so 5% outright downpayment ay 105K. since nakaka 200k na kami that time, wala ng prob. nakalipat na kami agad Smile

kung mag file ka naman sa HLURB, ayun, mejo matagal nga lang ang process base sa mga nabasa ko...
