I'm new here. Pa-advice naman please!

Bumili ako ng condo sa Victoria de Makati ng Feb 2009, and same with everyone else, di nakadeliver si NSJB ng promised turnover date of Dec 2012. Finished na ko sa downpayment ko which is 20% of TCP. Yung initial communication nila, may payment holiday daw, so di ako nagworry nung delayed yung unit, kasi hindi naman daw ako required magpay until maturnover. Tapos biglang nung tapos na ako magDP, sabi kailangan na daw icontinue yung payment na ang computation is same with their inhouse option, didiscount-an na lang daw sa interest. So nagdispute ako and requested for refund, which they denied. Tapos nakikipagnegotiate ako na icocontinue ko yung payment, pero same amount lang ng binabayad ko during downpayment phase, aba ayaw nila pumayag, kailangan daw 30% of the remaining outstanding balance. So nagnenegotiate pa kami, tapos they cancelled my account dahil failure to pay daw ako. Then after that may nagcontact sakin offering na unit na lang sa Fort Victoria, so nagconsider ako, pero sabi ko, they should give me the preselling price ni Fort victoria (this discussion is happening July to October 2012), tapos sabi hindi daw pwede at dapat yung current market value ni Fort Victoria. So yung account ko cancelled pa rin!

Now yung question ko, 2013 na kasi almost 2 years after i have finished paying my downpayment, pwede pa ba ako magclaim ng refund thru HLURB? Although may nakatayo na na mga 7 floors si Victoria de Makati, pero the intent clearly pa rin ni NSJB is to deceive the customers, at super self serving ng contract nila! Your advice please!

Hi there condo buyers.

Need an update !

Is there any news regarding getting a refund from NSJB? Kasi a collection officer from their office named Erin Sol Bontigao is somehow fishing regarding this matter. 50% nga lang daw ang makukuha because of that Maceda Law plus kung anu anu pang deductions and was also asking kung sino na daw yung nakapagrefund. I saw in an earlier conversation that some buyers got their refunds back.
So i just really wanna know if there's a progress already. Kasi in Victoria de Makati, we are asked to pay with interest after paying the full amount of the DP. It's really alarming na.

Help dont know whAt to do .. Last
Nov nag send ako ng demand for refund sa nsjb until now wala pa sila reply .. Kanina naka tangap ako ng letter coming from them na cancel na nila contract ko and forfeited na nila mga na hulog ko i even sent them my demand letter
Twice pero walang reply now forfiet na raw mga. Nahulog ko since fail to comply daw ako sa kanila .. ive finished paying my 20%dp last sep. Ive decides to refund coz alam naman natin na until now wala pang nagagawa or progress yung victoria station 2 nila pati guaranty wala cla maipakita kc till now wala pa lesensya.. what step should i do? planning to file a complaint na against them may laban ba ko? Help naman and im looking for a lawyer po if anybody know someone na might help me..

Ganito rin ang ginagawa ko. Bulgarang panloloko ito at pagnanakaw sa mga simpleng taong gustong umangat ng konti ang buhay tulad ko.

Help naman po. Nung nagpurchase ako ng unit sa kanila, ang promise nila by the end of 2013 daw pwede na mag move-in, pero wala naman sa contract yung sinabi sa akin ng sales agent... Grounds pa din po ba yun na makukuha ko yung down payment ko if ever ipa-terminate ko na yung contract?

November pa lang last year nag padala na ako ng request to terminate the contract at kumuha ng refund. May received copy pa ako. Pero nung December nagpadala sila ng demand letter for that month para magbayad ng monthly amortization pa din! Sabi ng customer service assistant nila i-disregard lang daw yun kasi May termination letter na kami pero nung January nagpadala na naman sila ng letter na kina-cancel na daw nila ang contract ko at lahat ng nabayad ko ay forfeited na. Tama ba yun? Tulungan nyo naman po ako, I really don't know what to do...

Good day to all!!!!

Regardless of all concerns that I have read on this blog I recognized that all condominium projects even it's not under New San Jose Builders Inc. have delays but based on construction time frame accomplishing a condo building takes 6 to 7 years. So Regarding their project in VICTORIA DE MAKATI that I always hear comments that it must be delivered 2013 I think it's reasonable that now they are saying that it will be turn over on 2015 last qrtr...Since they launch this project Last qrtr of 2009 or 1st qrtr of 2010.. Well I bought a unit here last 2011 then I have completed 20% of my Down payment last year 2013..They are offering me something that I considered it as an ADVANTAGE   Very Happy Very Happy Very Happy 
They are giving me an option to pay additional 15% Downpayment for another year and still without interest so my remaining balance which will be finance by the bank will be lessen. Another option is I can transfer all of my payments to their other project which other developer don't do transfer of payments to other projects or even to other towers in same project or they are just transferring a portion from your payment. However I am not considering the turnover date so I stick on the first option..Just Sharing this because some of us do complain because we don't look any positive aspects...

I've heard and review comments on this condo.. I understand that Its hard to accept that we have paid atleast 1/4 or even a half of the contract but still we are not occupying on the unit.. In my opinion I will give ample time for the developer to announce when is the very best time to occupy the unit for me to be safe enough.. Not to take risk my ownself unlike some developer is trying hard to fully occupied the unit but suddenly destroyed.. They just maintaining the safety of their client as well as their dignity as developer

Hi. Magandang araw po sa inyong lahat. Katulad po nyo may unit din ako sa Victoria de Makati na hanggang sa ngayon ay hindi pa natatapos after several times na napostpone ang turn over date. Ang construction ng project na eto ay di pa halos nangangalahati, ang unit ko po ay nasa 20th floor which is the last floor. Kailan ko pa po kaya eto magagamit? Kailan po ba talaga ang totoo at tunay na turn over date? Gusto ko pong irefund ung mga hulog ko kaso hindi daw pwede according to the law. They have given me two options. Option 1 is to transfer my payments to an RFO project or to any project of my choice. Pag ganitong choice po mapoforfeit na ung reservation nyo kasi. Ang reservation fee (rf) daw po according to them is not transferable at non refundable. Magbabayad po ulet daw ng 25K na rf tapos need daw ng 10%DP pa bago makalipat. Option 2 is to sell your unit, sa nangyayari ngaun sino po ba ang maglalakas loob na bumili sa kompanyang eto? May mga nabasa po ako dito sa forum na to na mas maganda daw ang nangyayari at bumababa ung balance nila kasi binibigyan ng bridging options, goodluck na lang po sa kanila.
Gusto ko pong sumali sa mga members dito na nagrereklamo at magsasampa ng kaso laban sa mga developers. Dun po sa mga members na nagpost ng positive dito sa thread na to kung gusto pa nyo ng unit sa Victoria de Makati sa top floor 20th floor pakikontak na lang po ako, for sale po ang unit ko. Ang Reservation Fee po or tinatawag na RF ay non - transferable at non - refundable, nakalagay daw po yan dun sa pinirmahan natin resibo sa pagbigay natin ng RF sa agent.

so sad meron palang ganitong forum dito about San Jose Builders, sana nabasa ko na to noon pa para di na kami nastress...i would like to react about the turnover date, most developers have issues meeting their promised turnover date, pero di naman ganyan kahabang delay...when someone buys a property they already have expectations, di pwedeng balewalain yun ng developer, lahat tayo may timeline, may schedule, sana kung delayed din ang bayad??? e kaso hindi naman!

May pag asa pa po bang makuha ung mga nahulog dito sa NSJBI, may unit po ako sa Victoria de Makati, ayaw ko na po sana maghulog pa kasi ang tagal tagal eh hindi pa natatapos ung project kaso ang sabi po sa akin kapag hindi na daw ako maghulog, makacancel ung account ko at wala ako makukuha na refund. 1 year to go pa po ako sa downpayment ko at ayoko na sana maghulog kaya lang natatakot din ako baka wala na ako makuha pa na pera sa mga hinulog ko. Dun po sa mga cancelled na ang accounts may pag asa ba na makuha natin ang pera natin? Ano po ba ang mga aksyon na ginagawa at gagawin pa ng mga cancelled account owners!?!?!

i would suggest, you go to HLURB, ask for their help,anyway trabaho nila yan, tapos make sure that all your concerns and demands are well documented, pag nagsasubmit ka ng kahit anong demand letter ipapareceive mo, kasi madalas sasabihin nila di ka naman nakikipag coordinate...magaling sila magdelay...imagine, yun ngang victoria de manila 1 nila, RFO na yun, last april of 2013 pa nagreserve ang friend ko and paid the 20%, with the expectation to move in by October kasi need ng matitirhan ng anak nya, awa ng Diyos, March na ngayon, di pa din nagagawa ang unit, ganun sila ka walang kwenta!

I also bought a unit here. Sabi ung turnover date is on last quarter of 2013. Pero khit konting movement sa building wala ako nakikita, malapit lang kasi ung office ko dito.

How about we bring this issue to the media? To Tulfo brothers... I am really worried because wala man lang construction na nangyayari and it's already 2014.

Hi fellow NSJB buyers,

sorry it took me a while to post my response. here is the detailed instructions that you might want to use to get your money back from this very deceiving company. Take note everything should be documented when it comes to them.

1. Your account with them should be current, they should not cancel your account due to non payment or else wala na kayong habol sa kanila. in my case hnde pa tapes ang dp when i asked for a refund, i am not sure if iba ang case pag nakapag full dp na kayo.
2. if your account is current, submit a letter intending to withdraw your payments in their head office, sa kamuning, it should be detailed, the total amount you paid, the reason why you acquired the property and that their turn over promise was not met, attach a copy from HLURB that don't have a license to sell. have them receive the letter, they will say it will be reviewed by someone but i tell you, delaying tactic nila yun so that when your due date comes, mapipilitan ka magbayad.
when i submitted my letter, i demanded that i get my pdcs before i leave the office. make a scene if you have too, thats what i did so nakuha ko pdcs ko.
3. after 2 weeks of not hearing from then when i initially submitted my refund letter, i went back and they explained to me na wala na daw ako makukuha due to maceda law. nag hysterical ako, sigaw ako ng sigaw sa kanila, believe me immuned na sila dun, i went to imbestigador that time and they said that they cannot do anything about it, and that it should be handled by HLURB.
4. i went to hlurb and filed a case thru a mediator, yung ang ginawa ko para walang bayad. my taxes should be working for me right,? trabaho nila yun to mediate between the developer and the buyer. after a month nai schedule ang meeting ko with the lawyer of nsjb, please make sure to followup with hlurb ang scheduled date, and make sure na attend kayo. ako kc, i did not take any chances, tawag ako ng tawag sa HLURb and even went there to check yung logbook nila for mediation.
5. my first meeting with the lawyer, very civil naman, explain nya yung reason ng company for not giving the money back since we signed a contract, dapat sabihan nyo ang lawyer na the contract is null and void since on their end wala pa silang license to sell, so dapat hinde sila magbenta at all.
6. after a month, 2nd meeting with the lawyer, sabi nya they will grant the refund pero i schedule pa daw.
7. after a month ulit, 3rd meeting, they gave me my refund pero minus the reservation fee of p10k, they they asked me to sign a quit claim, yung refund nila is pdc din na hinati sa dalawang check, kaloka, pero at least meron na akong hawak na refund, the quit claim indicates that it is only valid once they cleared the check

i hope this would be a great help to all of you. i am not sure if the same pa din ang process since this was over 2 years ago nung ginawa ko.

do not be fooled, be strong, minsan panghihinaan kayo ng loob, pero tuloy lang ang laban, wala silang kaso especially sa VS2 kasi wala pa slang license to sell.

hello may mairerecommend ba kayo na lawyer ? last 2010 kumuha kming unit sa Victoria de Manila,napakarami ng pagkakataon napatunayan nmin na pangit ang pagkagawa nila bumagsak buong kisame ng unit, natrapped kmi sa elevator ng almost 2 hours, at marami pang iba.. gusto na isuspend ang payment nmin and hoping na makakuha kmi ng pera sa almost 2 M na nming naihulog ..;(
