Good day Attorney!

My sister-in-law was recently accused of shoplifting in a local grocery. Yung nangyari po, nilagay nya sa eco bag yung mga pinamili nya, which is gnagawa naman mostly ng mga namimili doon dahil iilan lang ang mga trolley. Nung nasa cashier na sya, nilapag nya sa cashier yung eco bag. Inuna nya yung mga hawak nyang nabiling pagkain, sinunod nya yung sa bag,nangulit yung anak nyang 4 years old ng chocolate, inentertain muna yung anak, at nagbayad na sya. May naiwan po sa bag. Nung nilalagay na sa bag yung mga pnamili, hinawakan nung cashier yung bag, nakitang may shampoo, na wala sa resibo. Sinabi lng ng cashier "may shampoo", sinabi ng sis-in-law ko, "d ba nabayaran na yun?" Tapos hinayaan na ng cashier na ilagay nya lahat ng napamili nya dun sa eco bag. May mga shampoo and some personal items na hindi nasama sa resibo, amounting around Php 600. Nung palabas sya, naicheck pa ng guard yun resibo. Hanggang nasa labas na at tinawag sya kasama yung bata. Dun na sumagi sa isip nya ba't 200 lang binayaran nya. They went directly to the Gen. Manager's Office, pagdating dun minura mura sya. Marami pong foul words yung nasabi sa kanya, plus with threat na kaya ng Gen. Manager magbayad ng 12000 para ipabugbog at ipapatay sya, sa harap mismo ng bata. Nung dumating po yung kapatid ko dun, dahil tinawagan nga po nila, yung bata umiiyak sa takot tumakbo sa papa nya, inom nga lang daw ng inom ng tubig yung bata. Hindi rin nakapagexplain yung sister-in-law ko na namumula sa takot at hiya plus mura pa ng mura yung Gen. Manager. Naikwento ng cashier yung nangyari, na umpisa pa lng tinembrihan na lahat silang cashier na bantayan nga sya. Possible nga po na may history na sya na d namin alam. Kaya lang po, gusto lng naming itanong kung tama ba yung ginawa ng cashier na nakita na nga nayang may laman yung eco bag, nagverify pa sya, tinanong pa sya ng sis in law ko ng " d ba nabayaran na yan?".

May CCTV camera po pla yung establishment, na 2 araw na nilang tinatawagan yung technical crew para maretrieve yung video, until now d pa rin nareretrieve. Kesehodang wla yung technical crew nila. Kung nakapagshoplift nga sya sa ganung set-up, gusto po naming malaman yung opinion nyo sa kaso nya. Pinapabayad po sila ng x10 ng price ng d nya nabayaran, pero sa policy nila x6 lang nakalagay. Ayaw ng Gen. Manager ng kaso, wla din naman daw nangyayari, bayaran na lng daw sila ng Php 6800. Pag nagbayad naman sila, parang inamin ng sister-in-law ko na nagnakaw nga sya. Sa sobrang trauma nya, 2 days na syang nakakulong lang sa kwarto. Halos hindi na lumalabas ng bahay.

Sana po matulungan nyong maexplain sa amin kung diniin po sya o intentional nga yung ginawa nya. Salamat po ng marami.

Your case seems a little complicated and there many factors to consider. It is best to consult your own lawyer or you may settle the conflict to avoid litigation. But if you seek my advice, i recommend to file a case against the general manager for grave threat. Any person who shall threaten another with the infliction upon the person, honor or property of the latter or of his family of any wrong amounting to a crime,if the offender shall have made the threat demanding money or imposing any other condition, even though not unlawful.If the offender shall not have attained his purpose, the penalty lower by two degrees shall be imposed. with regards to the case of theft of shoplifting, it not settled whether the act is already consumated of attempted.
But if it is attempted and since your in law went to the gen. manager, it shows that she desisted from doing the crime and not criminally liable.
When you say history, does it mean history of theft or suffers kleptomania?
There are many factors to be considered in your case, but i hope it helps you to ease your anxiety.

Yung nangyari po kse, pagpasok pa lng nya sa store, naitimbre na sa mga cashier na bantayan sya. Hinala namin, posible pong nakalusot sya before. Tinatanong nga sya namin kung nakapagpuslit ba sya ng items dati sa grocery na yun, sagot nya hindi daw talaga. Kse nga hindi naman magwawarning sa lahat ng cashier na bantayan sya kung wla syang history na nakapagshoplift sya dati, hindi nga lang nila nahuli noon.

Yung case po nya ngayon, nakita na nang cashier na may items na hindi nabayaran, and nilagay nya mismo dun sa ramp ng cashier. Nasa loob nga lang ng eco bag. Tinatanong nga namin sa kanila, may hinala na pala sila, nakita na na may di nabayran na items, tinanong naman yung cashier, d man lang nilinaw nung cashier at tiningnan ulit yung items at ang resibo. Siguro po kung naginsist yung sister-in-law ko na nabayaran na yun, responsibility pa dn po ba dapat ng cashier, na icheck ulit yung items? Hinayaan pa po nila na makalabas sya at dun hinuli.
Di po ba dapat magundergo ng maayos na settlement and due process yun? Thanks again

kung nahuli po ba ang isang tao na nagshoplift sa isang department store ng isang ng isang mall, magkano po ba ang babayaran niya para sa item na nakuha nya? halimbawa po kumuha sya ng isang tshirt worth 5oo pesos, same price din po ba ang kailangan nyang ibayad or madodoble ang presyo nung item?

GOOD DAY ATTORNEY!!!

I hope this thread is still active. Is there any rule or law in the Philippines that if a Store Security Officer caught a person shoplifting an item/s , that person is given a chance to go back to the counter to pay the items he/she allegedly stolen, and he/she will be only be brought to the investigation room, if she/he continues to deny the charge? please enlighten me, thank you and more power to you.
