Hello atty good evning

Ask po ako advice about sa brother in law ko po... he have a property under his name and he separated to his wife.. he wanted to sale the property kasi need po niya money to under go chemo therapy. But ayaw nang asawa nya..ngayon po. Sekrito pong pinapalitan nang wife nya ang name nang propety po doon s certificate of land tittle po... pwede po ba yun na ilipat ang name sa anak nya na wla pong concents sa brother in law ko po?? Hope you can help me po atty..

Sabi kasi nang asawa nya ilipat raw po sa anak nila ang name nang property para hindi raw po mabinta nang brother in law ko po..nag file na po nang complaint ang brother in law ko po sa barangay para pag usapan po nila ang pag binta kaso po hindi po sumipot ang asawa nya po... pwede po ba e force nang brother in law ko ang pag binta nang property kahit hindi po mag perma ang asawa?? Para po maka start na po siya nang chemo therapy

FRom the declaration above, there was a change of name in the title. Bawal iyon, at saka madaling mahuli iyong magdala sa title TO THE REGISTER OF DEEDS,if there will be a Deed of Sale made. Remember that the the Register of Deeds has its OWN ORIGINAL CERTIFICATE OF TITLE KEPT IN ITS VAULT-The same title that your brotherinlaw is holding. Pagmayroong nabago sa mga entry na iyon na hindi galing sa kanila OR ANGMGA ENTRY HINDI MAGKATUGMA SA TITLENA HAWAK NILA, puedeng habulin ANG MAY-ARI IN WHOSE NAME THE TITLE WAS REGISTERED.

CHANGING ENTRIES RIGHT ON THE TITLE IS NOT ALLOWED. THIS PUNISHABLE BY LAW YAN. YOU WILLL AND IN JAIL FOR THAT ACT. SUING THE OTHER PART FOR the share is alright. If the property was acquired by the spouses during their marriage, then the spouse can have it divided equally among themselves. That would be the right thing to do.

So pag pina paliatan nang wife yung name nang tittle with the husband concent.. the husband can file a case to his wife???
