Sana po matulungan niyo ko. Medyo depressed po ako dahil sa kakaisip dito at need ko rin po ng Legal Advice.

A few months ago po, na-terminate po ako sa previous company ko dahil di ko po na-reach yung company standards although wala naman po ko absences at nilabag na something major.

Rank and file employee po ako at probationary. Less than 6 months po ang tinagal ko sa maliit na company na yun.

Now po, naghahanap po ako ng job na mas fit sa skills ko. This month lang po may nag-offer sa akin ng job. Entry level din po at rank and file din pero different siya sa previous job ko.

Di ko po alam kung magpoproceed ako dun sa offer kasi may non-compete clause yung contract ko. Sabi dun sa contract bawal daw po magwork sa business, firm, etc. na competitive dun sa business nila for 1 year (directly or indirectly).  

Ang problema po, yung company na nag-ooffer may subsidiary na naghahandle ng site na parang may similarities dun sa previous job ko. Kaso di naman dun sa subsidiary yung nag-ooffer sa akin ng job.

Kahit po ba sa subsidiary at different position naman ang aapplyan mo ay sakop pa rin po ba yun ng Non-compete clause?

In this situation po, need po ba na ireject na lang po muna yung job offer? Kahit po na terminated ako at di naman resigned employee.

Kung tutuloy po ba ko dun sa application at matanggap ako, malaki po ba ang posibilidad na kasuhan ako ng previous company ko?    

Wala naman pong nakalagay dun sa contract kung anong specific na penalties yung ipapataw in case malabag yung clause. Although di ko pa po nakukuha yung backpay at COE ko sa kanila.

Napepressure na rin po ako dahil gusto ng parents ko na magkawork na ko ulit. Kaya lang medyo hirap po ko makahanap ng work pero at the same time, ayoko naman po magka-legal problem.

Pwede ka naman mag work dun kasi di naman direct na competitor nila yun, yung subsidiary lang.

Ah salamat po sa advice. Pero may pahabol lang po akong mga questions.

Papano naman po kung hindi naman kinoconsider ng potential/new employer na direct competitor si previous company? Kaya lang si previous company tingin niya competitor si new.

Tsaka papano po kung magkaiba naman ng line of business or industry yung dalawa kaya nga lang si new company may service/division/department/project na may similarities dun sa ginagawa ng old company? Tapos parang nakaka-attract din yung dalawa ng similar clients. Let's say parehong students/young professionals ang market nila.

I don't plan naman to work for that particular division pero kung ganun, makakasuhan ba ko?

If ever man na kasuhan ang isang employee dahil sa breach sa NCC, may kaibahan ba kung terminated siya kumpara sa resigned?

Nagmamatter din po ba kung magkaiba ng position sa old at new company?

Thanks po sa makakatulong. Nag-aalala lang po talaga ko. Di ko alam gagawin kong hakbang.

kung alam mo namang hindi direct competitor yang new employer mo eh bakit ka mag worry.. hayaan mo mag demanda yung old employer mo..
