Hingi lang po ako ng advise sa case ko.

I'm currently employed sa dating Client ng previous employer ko. May Non-Complete Clause po akong napirmahan sa dating contract ko with them stating that I am not allowed to work in the same line of business. From my previous employer, I'm being neglected, yung work na binigay sa akin hindi pang BPO agent kundi pang Supervisor pero walang increase. Walang papers na ibinigay for promotion. But this client offers me good salary & position sa company nila. Pero ako po ang lumapit sa kanya para maging empleyado nila. Hindi sila lumapit sa akin para magtrabaho sa kanila. Kusa akong nagpunta sa kanila para makapagtrabaho. Ngayon naghahabol yung dati kong employer at nagfile sila ng case against me. Ang kasong ifiniel nila ay yung Non-Complete clause & Piracy. Nagsubmit po ako ng resignation pero hindi nila pinirmahan. Nagtungo ako sa previous employer ko para magpaexit interview at the same time exit clearance pero hanggang ngayon hinohold nila ang clearance ko pati ang yung mga documents ko para sa mga benifits. They already heard my side pero ganoon pa din ang ginawa nila.


Ano po ang gagawin ko? Should I seek help from DOLE or from attorney?

In addition to this matter. Ang pinagtataka ko yung mga kasamahan naming agent sa makati since nagpulled out yung client sa previous employer namin, bakit hindi sila hinabol at chinarge ng case since they are employed na rin sa client? Wala namang ipinagkaiba yung contract na pinirmahan namin from previous employer. Same clause. Pero hindi sila hinabol para icharges. Ang difference lang ay yung site. Sa clark pampanga ako at sila naman sa makati.

Hindi na ako nagrender ng 30 days. Hindi ko na po matake yung ginagawa nilang pagneglect sa akin as an employee. I just send my immediate resignation thru email & actual our hr manager acknowledge it. And then all of a sudden they just send me a termination letter stating that they didn't agree sa resignation ko. Hindi ko maintindihan bakit galit na galit sila sa akin at lagi nilang ichinacharge ay yung Non-Compete Clause.


May laban ba ako sa Non-complete clause na ibinigay nila? Ano pong pwede kong icounter charge sa case na ibinato nila?

Tinatakot po nila ako sa charges na ipinataw nila sa akin. I'm not sure what's going on with their minds pero hindi ko na po matake yung pang wawalang bahala nila sa mga concern namin as an employee.

Sa pagkakaintindi ko po sa labor code ng pilipinas.

Art. 285. Termination by employee.
An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.


An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

Serious insult by the employer or his representative on the honor and person of the employee;

Inhuman and unbearable treatment accorded the employee by the employer or his representative;


Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

Other causes analogous to any of the foregoing.



Kaya po ako nagsubmit ng immediate resignation, kasi po I'm being neglected as an employee & serious insult po sa carreer ko. hindi po nasusunod yung company rules for promotion.

Nahired po ako sa company as an back office agent after 1 year sa kanila, binigyan ako ng responsibility na maghandle ng mga agent. Every day report na dapat supervisor lang ang gumagawa. No recommendation made for a certain position & No increase at all. Kaya po ako lumipat ng ibang company kung saan binibagay ang gusto mo.
