Details
Reservation / Earnest Money = 10k
Deposit = 300k
Vehicle Price = 1,XXX,XXX
Concern is, does the seller have the right to forfeit the whole amount deposit if the buyer already cannot pay the remaining balance and wants to back out considering buyer never gained possession of the vehicle.
- Forfeiture of deposit / earnest money has no due date.
-If seller sells the vehicle to other prospective buyers without settlement with current buyer is this considered estafa?

He is entitled to reasonable damages but no outright right to keep the whole amount. However on your part, you will have to file a case to get the money back if they do not give it back. search small claims court

Atty Does the buyer have the right to back out from the deal considering the following
-Buyer agrees to take the deal since seller opened an option to part out some spare parts on the vehicle and tells buyer amount to be parted out would cost at least 500k. But in reality when posted for sale; the price for the parts would not even reach half of 500k
-Buyer thinks he was deceived with the price of the parts. No test drive happened initially; seller wouldn't allow buyer. When test driven car seems difficult to operate.
-Buyer could not continue payment because there will be no other source of funds unless the parts as estimated by seller (500k) will materialize
- Buyer never got possession of the vehicle since reservation and partial payment.
