Good day

I recently got married to my wife who is a single mother. Her son has the biological father's surname but they were not previously married. I would like to ask if there will be complications during the adoption process because of this or if the consent of the biological father is needed for the adoption to proceed. The father abandoned them with no financial support given to the child.

The consent of the biological father is needed usually.

I have received an opposition from the Office of the Solicitor General regarding this issue but the Court ruled in my clients' favor.

However, my clients' situation is different from yours since they are the uncle and aunt of the child, not the biological husband.
