Arresto Menor

is there any criminal case if a person under investigation refuses to be a witness?
or if the person did not appear during the trial?

and im a bit of confuse ... i read an article that says that rights against self-incrimination is only applicable if criminal case ...
other article said that right against self-incrimination is applicable on administrative, criminal or any other government proceedings.

this is for educational purposes ... Smile hope you can help me with this
