Meron po kasi kaming bagong policy about sa sales. Nakapag di kme naka kota ng 3 sunod tatanggalin na po kame. Ang tanong ko po may legal baae ba un if sakaling pirmahan namin un?? Or may habol kame kung bigla na lang kame tanggalin?

bear in mind the company can institute a policy even if you dont sign it. They just have to make you aware of it.
Tama ba pagka intindi ko? The quota matagal na meron but now ang policy is if mag miss ng 3 straight quotas, you will be terminated? If tama
They can do this citing subpar performance. But they need to go thru the process, meaning 1st month pag hindi nag quota, dapat may sulat informing you and asking why. Baka kasi may external factors, such as binaha dun sa lugar where you sell etc etc. If they do this, they can terminate you.

bali 1st month written warning, 2nd month final warning, 3rd month dismissal
ang akin lang po pano naman po yung mga matatagal na sa company.
halimbawa po ay naka 5-6yrs na sa company ng dahil sa bagong policy performance
mawawala yung tagal ng serbisyo mo bigla at wala po bang pedeng makuha kung sakaling matanggal ka sa work??

if matagal na yung quota, mahihirapan yung complaint to prosper. Pero pwede ka parin mag file as "unfair" practice medyo mahirap lang manalo.

Before 6mos ang palugit nila. kasi 3 mos di ka komota pagbibigyan ka pa nang another 3mons saka lang magreresign pag di ka pa din naka reach ng kota mo.

Now 3mons na lang pagko mota ka marereset ung bilang ng di mo pagkota pero pag sunod sunod na di ka komota 3x sunod na buwan tanggal ka na. Tama po ba un or mali un sa labor code??

At isa pa po may bago policy again na dapat mag in and out ka pag mag break ka once na di ka nag out during the break or di mo ginamit ang break mo kakaltasan ka ng 1hr sa sahod mo. yun po ba yan tama?? hindi ka na nga kumain o lumabas ng store babawasan ka pa nila sa sahod mo?

yes they are within their rights to do so. Pag sa sales kasi actually pwede na sila mag warning basta hindi ka mag quota. Pwede nila sabihin na they were lenient before but now they have to be stricter.

Hindi pwede mag deduct more than what you have missed/not worked. But ang gagawin lang kasi nila is instead of deducting "an hour" ang sasabihin, you are being fined P100 everytime you do not time out for your break. That would be legal. Pero bakit hindi ka nalang sumunod at mag out? If its company policy and sinabihan naman kayo, why fight it?
