Good day Attorney

Need some advice po...

We're having problems po sa common land na naiwan ng mga grandparents ko...

Pero napagusapan na ng magkakapatid kung kanino mapupunta ang part of the property...

Then here comes the problem...

Ung part ng father ko which is not transfered to his name ay paghahatian naming 3 children sa 1st wife(not divorsed) and 4 children sa 2nd wife(married din according to my father and his new wife)...

1st question ko po is may makukuha ba talaga ang 4 sa 2nd wife kuno?

2nd question po is if binibenta ng kapatid ng father ko ang property ano po ang magagawa ko para maibalik sa amin ung nabenta na...

patay na pala father ko 1 year ago...

If the 2nd marriage is bigamous, then the children are considered illegitimate. They are only entitled to 1/2 the share of the legitimate children of the first marriage. Ex. kung 100,000 ang share nyong magkakapatid, ang share nila ay 50,000 lang. As to your 2nd question, kung iisang property lang yan at binenta ng uncle mo ang share nya, kayo as co-owners ay may right of redemption. Pwede nyong bilhin mula sa buyer ng uncle mo yung property na binenta nya.

bale po 50-50 pa rin ang makukuhang share namin lahat?

dun po sa property naman po...
ehohonor na daw kasi nila sa father ko...
if thats the case po ba pwede naming kunin ung binenta na property? pero ang malalagot po is ung uncle namin? tama po ba?

pwede nyong kunin yung property basta isoli nyo yung pera ng buyer. kung buong property ang binenta ng uncle mo, kunin nyo sa kanya yung 50% ng proceeds ng sale. yung 50%, kanya na yun.
