Atty., I came into this writing as I need your legal advise regarding our situation.

Bumili po kami ng Van, from 1st owner - me pinirmahan po kaming "Deed of Absolute Sale with transfer of Mortgage" . ito pa lang po ang papel na meron kami at yung sasakyan. Nag -issue po kami ng Cheke, at yun na po ang ginagamit pambayad sa monthly amort. ng van.

Yung sasakyan po pinapa-rent namin sa isang kaibigan.

After 10 months, kinontak po pala nung pinapa rentahan namin yung first owner, at nabigla po kami nung biglang tinanggalan po kami ng karapatan sa Van, at ng right na makipag transact sa banko. Nagkaroon po sila ng panibagong kontrata, at winidraw po ng seller (first owner) yung lahat ng cheke namin ng hindi namin alam, at ipinalit ang cheke nung Third party.

Ask ko po sana kung kelan po ma-waive or pwedeng i-cancel ng first owner yung agreement- deed of sale- na pinirmahan at ibenta nya ulit sa iba ang sasakyan, na naka mortgage pa rin sa banko.

Anu po ba pede namin i-kaso sa first owner?
Kailangan ko po ba mag punta sa Bank para i-advise sila? Sa legal dept po ba?
Panu ko po mababawi ang car?
Anu po ang unang step na dapat ko'ng gawin? Mag-file na po ba kagad ako ng kaso? Hindi ko na po kasi ma-kontak ang first owner. Hindi na po cya nakikipag- cooperate.
