Atty. Please help, kasi po may binili kaming lupa sa Pilipinas na 5 years to pay kaso po nagkaroon kami ng penalty dahil sa mga late payments namin nasa UK po kami ng misis ko at yung biyenan at sister ko po ang nagbabayad sa realty pag nagpadala kami ng pera pambayad. Mahigit 1m na po ang nihulog namin at kulang na lang po mga 600k pati penalty namin. Kapag daw po di namain nabayaran yung penalty ng buo within about 60 days agter ng date na nakasaad sa letter po nila di na raw po kami pwedeng magbayad at kanselado na raw po ang contract namin at yung mga naihulog namin e porfeited na raw po. nag email po akjo sa kanila humihingi ako ng palugit pero di pa po nag reply second time na po di na raw po pwede. parang binibigyan na po kami ng hard time ano po ang dapat namin gawin at tama po ba yung action nila? please advise po. makakabayad naman po kami kaso po baka di po namain mabuo mgakulang man konti lang yung monthly po namain updated na yung penalty charge lang po ang hindi updated. maraming salamat po sa legal na payo nyo.

if you are already updated on your monthly payments and this is recognized by the company, I would argue that it would be illegal to cancel the contract because of non-payment of penalty.

my action would be to write them a letter stating our legal position and warn them not to proceed with their action. if they do, your recourse is to file a complaint at hlurb.
