In our contract we need to render 60 days notice prior to resignation.

Under law, only 30 days is required.

In the contract, there is a penalty if we will not comply with 60 days notice.

Is this legal?

Please advice.

Thanks!

in my opinion, no, this is not legal unless your position is listed as mission critical by the dole

Ok.

So can I just bargain to render 30 days notice instead of 60 days even though I signed the contract?

What if they will not release my last pay?

Pls advice.

Thanks atty!
