will annullment be granted even if the respondent has no participation at all?

Arresto Menor

good day! i just want to ask if it is possible to grant an annullment even if the respondent didn't attend any of the hearing nor didn't sign anything?but summons were properly serve, thus the last letter that was received was like this:
today is supposed to be for the reception of the respondent's states/evidence. however, respondent is absent despite due notice.the public prosecutor manifested to the court that he would not present evidence. thus as jointly prayed for, this case is now considered submitted for decision.
