Hi atty ask ko lang po about dun sa case ko.Just to give you background. I was previously a call center employee assigned sa payroll.When the payroll manager resigned,the Finance Manager become our OIC and that manager obvisouly did not like me. She served me a preventive suspension for Disrespect and Tampering of hours pero wala po nakalagay na scenario or situation sa memo how i committed the violations. Regarding po sa disrespect issue,nalaman ko po na nag base lang po sya sa hearsay, wala po akong sinasabi sa kanya directly, may nagsabi lang po sa kanya na Im saying something against her. and sa tampering of hours naman po,nagwowork po kami ng more than 24-48 hrs during payroll processing kaya lahat po un pinafile namin na OT in excess of 8 hrs ganun din po un mga kasamahan ko pero sya rin po ang approver at nag-iinput sa system kaya imposible un sinasabi nya. Nun ika-30th day na po nun suspension ko, pinatawag nila ko sa office para sabihin na wala pa sila decision at may binigay po sila sakin na panibagong ieexplain ko. Pinapabalik po nila ko kinabukasan para ipasa un explanation ko at para daw sa hearing regarding dun sa disrespect dahil may nagconfirm daw na kaofficemate ko na may sinabi ako sa kanya na masama against sa manager namin. Ang ginawa ko po nagfile na lang ako sa NLRC kasi tapos na un 30 days at mukhang constructive dismissal na ang ginagawa nila. Nalaman ko rin po na terminated na ko sa record ng HR na hndi man lang nila sinabi sakin un naging decision at hindi sinerved sa kin un dismissal. Wala na pong tumawag or kumontak sakin after nun pumunta ko sa office. Nagharap na po kami sa nlrc at gusto po nila makipagsettle na lang.Eto po ang ihihingi ko po ng payo sa inyo atty.:

1. Humihingi po ako ng payment ng backwages ko from the time na sinuspend nila ko until un day na nakipagsettle sila.
2. As per policy,SL lang po ang convertible pero di ko po nagamit yun VL ko kasi sinuspend na po nila ko,tama po ba na hingin ko rin yun cash conversion nun? 3. Sinabi na po nila na hindi na daw po nila ko marereinstate, kaya po humihingi po ako ng separation pay.
4. Hindi po nakapost yun mga SSS ko, panu po ba ang process nun kung hindi pa rin ayos kung sakaling tapos na yun kaso.
4. I clear po nila yun record ko at di ilagay na terminated ako.

Sa separation pay, malabo daw po while regarding the backwages they are still thinking about it. And we are set to meet on Sep. 2 for the settlement and yun na po yun pang 4th hearing namin sa mediator.
