HELP on Illegal Suspenion / Preventive Suspension

Hi Guys, I am seeking help from you on what to do about my case, i worked at a BPO for 3 1/2 years now but we renew contract every year Jan-Dec as an I.T. Support Specialist. Here's the situation, Last May 18 2k13, Our President emailed our helpdesk email/it group email to DISMANTLE A CUBICLE which is not a JOB for a I.T. Support. Our IT group is consisting of 4 Employee, on that day i was ABSENT, but when i came back on sunday, my colleague told me that I and one of my colleague is having a SUSPENSION ORDER/ Preventive Suspension for 30 days, in wich I dont know why? when i received the PREVENTIVE SUSPENSION, it states that the first reason is NEGLECTFUL ATTITUDE IN THE PERFORMANCE OF ASSIGNED JOB RESPONSIBILITIES second is INSUBORDINATION OR WILLFUL DISOBEDIENCE OR REFUSAL TO FOLLOW COMPANY POLICIES, DIRECTIVES, RULES, AND REGULATIONS OR SAFETY PRACTICES.

Can someone help me on what to do? Because in my 3 1/2 years of work I havent received any citations on my job, and I feel that this is a personal matter on out PRESIDENT to us (i.t. Group) Please Help us on what to do leggaly, I guess theres no DUE PROCESS MADE

Please be informed that after the incident we dont want to go back again to that company because our WORK RECORD is at stake,

you said you renew your contract every year? why is that? are you employed directly in the BPO or thru an Agency? If you renew your contract every year, your 3.5 years doesn't really matter..

with regards to the suspension, there must be due process, so you can contest your suspension.

Sir Patok, Directly employed po kame sa BPO kaso po ang contract na pinipirmahan namen is every year po, ano po kayang maaring nameng i-reklamo sa NLRC and kung sakali po ano po ba ang pwede namen makuha?

bakit yearly ang contract?? so hindi kayo na re regular.. don pa lang parang mali na yun..

Opo eh, yearly po ginawa yung contract namen, as far as i know for LEGAL MATTERS daw po ng company, mga super visors lang po ang mga regulars, kahit isang empleyado po walang regular, lahat ay 1 year contract po.

dapat nilapit nyo sa labor yan.. continous employment tapos 1 year validity ang contract? pag ganyan umiiwas lang yang company na yan para ma regular kayo.. dapat mabisita nang DOLE yan..

Ang pag kakaalam ko po kasi eh, inilapit daw po nila yang ganyang status ng employement sa Company Attorney, kaya ok daw po yan (per company)

oo nga po ayun din po ang sinasabeng confusing dun, at sinasabe po nila na pag hindi ka na daw po nagustuhan ng CLIENT/Management eh pwede ka po nilang sisantehen anytime kahit di pa po tapos ang kontrata mo, my power of attorney daw po ata na sinasabe sila kaya 1 year 1 year lng po ang contract ng empleyado
