Good day!
My "former" friend/officemate (let me call her SNOW) asked me to be her co-maker but unfortunately all of the checks she issued bounced due to insufficient/closed account last year. We talked to the loan agency and she promised she will settle since the agency gave her an extension. But again, she didn't.
It was a joint account opened just for that loan and i don't have intentions of paying that since it's her loan. I keep on pushing her to pay since they've been sending letters addressed to both of us.

I just received a text they filed 6 criminal cases to BOTH of us.
Been trying to reach Snow but the last time she texted was March. She even said if she dies-i'll get some money to pay her debt.
Do i have any rights to refuse to pay it since Snow is still capable of paying it and just hiding from her obligations? It's really obvious that she's hiding since she's not answering any of my calls/texts.
How long will it take for a subpoena to be issued to us? I was also tricked by this person and I won't pay any of her debts.

Any advice would be greatly appreciated.

are you a signatory of the check? if not, no criminal charge should prosper against you.

could it be that this is just a scare tactic to force you to pay? normally takes about 2-3 weeks until subpoena is received.

as a co-maker you are obligated to pay. if you will not, and a civil case is found against you, the sheriff will look for properties registered in your name, if there are any.

Thanks for replying! There was a joint account opened for her loan and honestly I can't remember if I also signed the checks.
In case we both received the subpoena and she don't attend, can they file the charges against me? Pwede ba talaga akong makulong if i am one of the signatories of those checks and I refuse to pay?

a criminal case can be filed against you if you were one of the signatories of the checks. try to avoid personally receiving any letters and notices of dishonor.

I received a notice of arraignment and preliminary conference and submission of counter affidavits. is this the subpoena? what will happen if i don't attend to this? the one responsible for this don't want to communicate. shall i ask for copies of the bounced checks to make sure that i signed them?

that means preliminary investigation is over and it is now in court. is this the first time you received a notice about the case?

you should file a motion for reinvestigation to inform the court that you were not given the opportunity to file a counter affidavit and the case be reverted back to the prosecutor. you only have 5 days.

if you don't attend the arraignment, a warrant of arrest will be issued against you.

so did you sign the checks?

hello mocha,we incountere the same problem as one of the signatory in the check,the maker is not visible anymore...Its realyy a great burden to us since we are not the one who will use the money.Pls share to me what have you done to solve the case...
