Hi atty,

I bought po a land na 1 hectare kay Mrs.A..nabili po ni Mrs. A kay Mrs. B ang lupa. Inheritance po ni Mrs. B yong lupa sa kanyang mga magulang.we made necessary inquiries po sa assessors office regarding the land and naging malinis na man po.we made publication po nito and naging maayos din po.

Nang mag file po kami ng approve plan para sa titling, nalaman po namin na nasakop sa land title ni Mr. X yong lupa. ang ginawa po namin hinalungkat namin yong history ng lupa.

Ang mga magulang po ni Mrs. B ay may 8 hectares...ito po pinaghatian ng 4 na anak so bale tig dalawa sila.

Pinagbili po Mrs. B kay Mr. X ang isang hectare ng lupa out of the 2 hectares. Meron po silang deed of sale year 1970 na we got a copy from the assesors office kasi nakafile. It stated there po 1 hectare out of the 2 hectares ang pinagbili..yong remaining na isang hectare po ang binili ni Mrs. A na siyang nabili namin. meron din po kaming kopya ng deed of sale between Mrs. B and A.

Nakabili din po si Mr. X ng another 2 hectares sa kapatid ni Mrs.B.

In 1982, nagpagawa ng deed of sale si Mr. X na yong dalawang transactions sinakop niya in one deed of sale..nakalagay din po sa naturang deed of sale na ginawa nilang reference yong original na deed of sale in 1970...lahat po ng technical description, andoon except for ONE THING po, yong isang hectare ginawang dalawang hectare. Ito po yong deed of sale na ginamit nila para sa titling.Nakakuha po kami ng kopya nitong mga dokumento sa ROD. If you make a reference po ba sa ibang documents, isn't it vital that you attached it?

What is evident din po sa 1982 deed of sale is the fact that there was erasure or "tamper"..very evident po yong 1 na ginawang 2...wala pong initials sa changes na ito..isn't it that if you make changes po to a legal document, you should do this? Pati po taga ROD naka notice ng changes na ginawa.

Also po, we talk to the living heirs of Mrs. B and they said po talaga na only 1 hectare was sold..sila po yong naka sign din po sa 1970 deed of sale..

Ano po ang gagawin ng pamilya namin ngayon? malaking pera din po ang binayad namin..

need legal advice po.

are these properties covered by titles at the Register of Deeds? which ones are, and which ones are not?

yong isang hectare po na dapat hindi kasali, sinali po sa title na nasa register of deeds..

dapat po kasi out of the 2 hectares, 1 lang yong binenta nila and its covered by the deed of sale executed in 1970..pero nang nagpatitle na yong si Mr. X, sinakop niya lahat ng 2. nagpagawa siya ng deed of sale year 1982, ginawa niyang reference yong deed of sale ng 1970..everything is the same except that yong 1 hectare ginawang 2 hectares..its an erasure po na evident and no initials whatsoever sa deed of sale. yong heirs po na nakapirma sa deed of sale 1970 can attest that they only sold 1 hectare and not 2.

then you will have to talk to mr. x and show him what you discovered. if he does not transfer the property to you, you can threaten him that you will file a case for reversion, and estafa through falsification of public documents.
