Just to follow up. If it's legal, for how long can an employer put their employees on a No work No pay status?

yes it is legal, and they can put you on a no work no pay status up to maximum of 6 months.

if 6 months na and wala parin silang trabaho na mabigay sayo kelangan ka nilang bigyan ng separation pay

i clarify ko lang, hindi ka pinapapasok ngayon ng employer? naka floating status ka? dont refer to it as no work no pay status, most people kasi naka no work no pay, for example pag may typhoon, walang sweldo kasi no work.
if ayaw ka papasukin ng employer kasi wala kang gagawin, floating status tawag dun

Yes po.. going on 4 months now na nilagay kami sa no work no pay status. They removed us from the account, until now wala pa din mapaglipatan samin. Though they've tried to endorse us, we've gone through some interview/application but we failed.

yes i'm assuming kaya kayo na floating status is because yung account na hinahawakan nyo ay natapos na? (hindi nag renew ng contract yung client?)

@lukekyle Hindi po, stable pa din po ang account. Hindi naman nag pull out yung client.

Ang nangyari po ay inalis lang kami.. they accused us of fraud, na hindi naman nila napatunayan during the admin hearing. Instead, they held us liable for Gross Neglect.

Ginawa nila yun para masabi sa client na na rectify nila yung issue. Kumbaga, inalay po kami.. ginawa kaming fall guy.

Ano po ang take niyo dito sa argument na ito?

Regarding your case, I've seen that the employer did try something in their end:
they've tried to endorse us, we've gone through some interview/application but we failed. wrote:

Don't get me wrong po.. Bali I'm just asking lang po for your thoughts or opinion dun sa argument na yun. Kasi parang it contradict yung paglalagay ng employer sa no work no pay kay employees.

Yes they did their part po. Pero what happened during interviews was more of interrogation about sa kinaso samin. Kumbaga, walang proper endorsement. Kaya yung iba napilitan nalang mag resign dahil na feel nila na wala naman pupuntahan.

pls stop calling it no work no pay status. its called floating status. Yung ni quote mo is floating status.

Or ang tanong mo ba is tungkol sa floating or sa no work no pay status kasi nga magkaiba yan.

Dumaan din kasi kami sa floating status then pinapirma na kami ng no work no pay afterwards. Siguro medyo na confused na rin ako, pero sinabi niyo na naman na magkaiba yun kaya ngayon alam ko na. Saka hinihingi ko lang naman ang thoughts niyo dun sa article na yun. Dahil alam ko na you know better.

You said 30 days... then that is not indefinite. Hintayin nyo na lang na i-deploy ulit kyo sa ibang account. If not, after 6 months, entitled kayo sa separation pay.

Kung di mo matiis e mag-resign ka dahil legal yan.

You said 30 days... then that is not indefinite. Hintayin nyo na lang na i-deploy ulit kyo sa ibang account. If not, after 6 months, entitled kayo sa separation pay.

Preventive Suspension po pala yung ginawa samin. Sorry, my bad.

Wala na po kami tiwala na mabigyan pa kami account. Mag aapat na buwan na kasi. Gaya ng nabanggit ko, kung may pa interview man sila ay more on interrogation yung nangyayari, hindi kami natatanggap, mas preferred pa ng hiring manager ang external. Dahil siguro sa kinaso samin. Parang constructive dismissal na nga po eh..

legal nga ang floating status up to 6 months.. pag lumampas nang 6 months.. they need to retrenched you..
