gud day, isasaguni ko lang po sana ung kaibigan ko nag apply ng line sa isang big company celphone line , hinde nya po naintindihan yung agent na nag alok sa knya,kumuha po xa ng consumable package at 3,000 po un credit limit nya,24mos. po ang contract nya.. sa sim card plang nag bayad na xa ng 1,200 for activation ng sim card,after 1 week he receive a txt messages from the company na he need to pay 1,500 ... binayaran nya po agad un dahil akala nya un na yung cut off period kahit di nya pa nagagamit ang line only for txtting lang at local calls...pero my free txt at free call daw po ung package na nakuha nya.. after 2 1/2 week daw po he receive another payment na he need to pay 2,50o+ ,,di nya po ito binayaran..after 1mo..he had bill 6,tw plus.......3,tw credit limit ang apply nya at consumable po un... ang pinag tataka lang po namin eh.. bakit di nila sinabi na kahit di ginagamit ang line eh nag bi-bill po un.. nag punta xa sa smart para ipa cut ang line binayaran nya po yung credit nya..pero hinde po pumayag ang agent sa loob na i-cut ang line... now po ay may nag txt na naka demanda xa dahil di nya tinapost ang contract...na 24mos. 1mo. lang po na nasa knya yung line ..di na nya ginamit ang line after na nag report xa na ayaw na nya ng line kasi di po maganda yung naging experience nya... pero until now naniningil pa rin ang company at nanankot pa na aka demanda daw po xa kung di nya babayarang ang almost 25,000 na utang nya ngayun..lumaki na po ng lumaki kahit di na nya ginagamit ang phone... alam naman nila na di na active ang line at never na nay po itong ginamit.. ano po bang dapat nyang gawin? kasi po isang bbae angtawag ng tawag at nanakot na at nag papadala ng message galin daw sa atty. lahat po ay via txt lang dun po sa isa nyan no># na ginagamit nya... pati po sa akin kasi po ako po ung required person na iniligay nya pati po no# ko.. kung anu po yung sent nya sa kaibigan ko ganun din po yung sent nya sakin..di na po nakikipag usap un friend ko kahit tawagan xa ..at ako din po ay nagugulo ng mga tawag galing sa company na yun// kaya po alam ko lahat ng txt at tawag galing po sa staff ng SMART help naman po anu dapat gawin.. pwedi po bang kasuhan nag kaibigan ko ng criminal case kahit bayad xa at sobra sobra pa sa credit limit na pinirmahan nya? kasi creminal case daw po ang kaso nya sabi nung tumatawag na babae... may kaso po ba tlga na pweding isampa? help naman . salamat po..

is there a free phone that came with the package? what happened to that?

i believe what has happened is that his account has been transferred to a collection agency. i think that if a case if filed, it will only be for collection.

no phone.. they had a promo for laptop and need to pay the notebook laptop..for only 7,500 but di po kinuha ng friend ko un lappy so bale un sim lang po ang nasa knya... wala po xang kahit na anung kinuha s acompany maliban sa sim card po... na binayaran nya ng 1,200 para maactivate un sim... ang nakaka pag taka po kasi kahit di nya ginagamit eh nag bi-bill xa... now almost 6mo. na po pero lagi nila pa din akong kinukulit kasi nga po no# ko un reference ng friend ko.... may kaso po ba tlga yung ganun?? kasi po it seems na nanakot kasi sila sinasabi nla na kaaksuhan nila ang friend ko ng criminal case... at 25% na atty. fees... kung di babayaran ung 25,000 + interest pa daw po... Sad bakit ganun sila.. PWEDI POBA TLGANG KASUHAN ANG FRIEND KO??? PLS HELP PO SALAMAT...

if they are broadcasting what they intend to do, then i don't think they'll actually file the case.

yan po lagi na rereciv namin... pareho dahil nga po no# ko ung ref. ng friend ko... samin po nya pareho yan sent... honestly po.. wala po tlga xang utang dyan sa smart ..kasi nga po paid nya lahat bago nya di ginamit ang no# ..dahil ayaw nga po nila cut ang line... kaya nag sissyun po xang wag ng gamitin... pero dahil nga po sa contract na 24 mo. kaya siuro lumaki ng lumaki ang babayaran nya 25 tw plus po... ATTY. wala naman pong ganyan kalaking halaga ang friend ko... at malinis po konxenxa nya na talgang di nya ginamit ang line... do u think po pwedi xang kasuhan?? at kung may kaso naman po anu pong pwedi nyang gawin?? or sabihin sa court... maraming salamat po ulit s apag sagot sa concern ko.. god bless you po!

yes, he agreed to a 24 month contract, but it should just be a civil case for collection.

Hi Atty,

Recently, wala pang 2 weeks nag apply ako ng smartnet phone /unlisocial. Ads says plan 349. Unlitxt smart to smart and then unlisocial as per ad, unli fb and twit including yahoo messenger. Chinecheck ko yung bill ko online, me running balance na ko ng lagpas 600 as of today ( may credit limit na 800). Gusto ko na iterminate yung kinuha kong plan pero sigurado ako na pagbabayarin ako ng pre-termination fee. As a customer, if di naman ako nasiyahan sa service that they promised to provide, am I still liable for a pre-termination fee? I am willing to pay the bill and in fact I am willing to just pay the unit , pero pre-termination fee for breach of contract? i dont think its fair when they themselves ay di sinunod ang contract by not providing me the services na sinasabi nila sa commercial.

Please advice. Thank you
