Minor driver versus DUI

Newbie here. I am Annie from Makati.
I would like to know who should be held liable in this accident. Let me share the story po.
My nephew is 17yo,no license and he drove a motorcycle.
There was another driver in front of them who was drunk and drove carelessly. He sometimes sped up then slowed down but suddenly went full stop. My nephew tried to dodge but they were still hit.
The driver got off and tried to punch them but my sister and her boyfriend were behind them so he sped away. It was found out that the other driver has no license too.
In this case, what could be the penalty for my nephew who's unlicensed minor and the unlicensed drunk driver? Can each file a case against each other?

Pero kung kaya pang pag-usapan at maiwasan yung pagsasampa ng kaso, dapat dumaan muna kayo sa mediation kasi baka naman pwedeng danyos na lang ang ibigay nung nakabangga na lasing.
