Hi!

I still have 8 unused leaves (and the leaves we have is multi-purpose, no limit for vacation/emergency/sick leave). I filed a 5 day leaves in between my day offs because I'm going home to province (Leyte).

01/23, Tues - Off
01/24, Wed - Off
01/25, Thurs - VL
01/26, Fri - VL
01/27, Sat - VL
01/28, Sun - VL
01/29, Mon - VL
01/30, Tues - Off
01/31, Wed - Off

And here's the thing, they approved me for 3 days VL (Jan. 25-27) and they told me those 2 remaining leaves will fall under LWOP.

My question is, is it valid?

Because I still have 8 unused leaves. I thought it will be considered as LWOP if my leave credit is already zero.

Thanks.

check your company's policies, leaves might not cumulate or carry over after a new year. but if you have been working for the company for over a year, tell them that you are entitled to the legal minimum Service Incentive Leave of five days

Hi Atty LLL,

Thanks for your response. Appreciated it.

As per the company policy, every month, we gain 1.3 leave and I've been in this company for 9 months. As of the moment the remaining leaves that I have is 8.

If we reach 1 year in the company, all the remaining leaves (if there is) will carry over to the second year. And when we reach our second year in the company, only 10 unused leaves (maximum) will be converted to cash and the excess (if there is) will be forfeited. Then 20 leaves will be credited to us.
